On behalf of the State of North Dakota, the NDDPI will be submitting a fiscal waiver application with respect to the Elementary and Secondary Education Act of 1965 (ESEA).

Due to the COVID-19 pandemic, the U.S. Department of Education (USED) is offering each State educational agency (SEA) the opportunity to request waivers that will afford additional fiscal flexibility for certain funds received under the ESEA. These two waivers will allow the SEA to waive, more than once every three years, if necessary, the 15 percent carryover limitation in ESEA section 1127(a) for FY 2020 Title I, Part A funds and extend the period of availability of FY 2019 funds for programs in which your SEA participates.

The NDDPI believes it would be beneficial to North Dakota schools and districts to pursue this fiscal waiver. The USED requires states to provide all districts and interested parties in the state with notice and a reasonable opportunity to comment on this waiver request.
