FAQ Answer

Federal Regulations reflect two exemptions in Part 395: (1) an agriculture exemption, and (2) a 150-air-mile (short haul) exemption.

The main difference is that with the 150-air-mile exemption, the driver must return to the work reporting location and is released from work within 14 consecutive hours and with at least 10 consecutive hours off-duty separating each shift. The motor carrier must maintain and retain 6 months of accurate and true time records.

With the agriculture exemption, the load must be agricultural products; there are no time record keeping requirements when loaded within 150-air-miles; but time records must be kept when empty.
