We are authorized by statute to verify the independent contractor status of current or future work relationships for work performed in North Dakota. While the independent contractor verification is not mandatory, it helps the company and the contractor avoid future disputes regarding the nature of the work relationship.

This verification is conducted based on information provided on the form, and is effective only so long as the work remains unchanged (changes to the work relationship following the verification may invalidate the verification). Both the worker and the firm must sign the form to start the verification process.

After our review, we will notify the worker and the firm of the outcome. If we determine the worker is an independent contractor, both the worker and the firm will be notified in writing, with a certificate issued to the worker.
