Employers: Income Withholding

General Information

Income withholding by employers is the most effective method for collecting child support. Income withholding is governed by federal and state laws and is a process through which payments for support are withheld each pay period from the income of an employee. "Support" includes payments for child support, medical support, and spousal support. Employers are notified to begin withholding via an Order/Notice to Withhold Child Support (hereafter referred to as "income withholding order"). Employers are not required to vary their pay cycles to be in compliance with an income withholding order. Employers transmit withheld payments to the entity designated on the income withholding order.

January 1, 2005, changes were made to how the ND Child Support program calculates the amount to be withheld when an employee no longer owes current support but continues to owe past-due support.
