Medical Marijuana for ND Veterans

The use of Medical Marijuana in North Dakota was approved by 64% of ND Voters through measure 5 in the 2016 November General Election. ND legislators further developed the guidelines and regulations which are covered under the North Dakota Century Code 19-24.1 and North Dakota Administrative Code 33-44-01. A North Dakota Medical Marijuana Card can be applied for by ND Residents to treat certain debilitating medical conditions as defined in NDCC 19-24.1(15).
Veterans Affairs is a Federal Agency it must follow Federal laws. ND Veterans using the Federal VA Healthcare System will not receive a VA Doctors perscription for Medical Marijuana as it is classified as a Schedule I controlled substance by Federal Law.  
ND Veterans may gain access to Medical Marijuana to treat certain debilitating medical conditions. The veteran must provide a copy of 12 months of his/her VA treatment notes for the claimed debilitating medical conditions in place of a Dr.'s recommendation.


You will need:

  • 12 Months of VA treatment notes for claimed condition

1) Create Account

a. The Veteran will need an email account and have access to that account to register

b. Email is used to verify the registration

2) Sign into the Account

3) Under Applications, choose “Patient Application”

4) Take photo of Veteran. (similar to Drivers License or Passport photo)

5) Take photo of Veteran’s ND Drivers License or ND ID Card

6) Upload Veteran’s Picture

7) Answer the questions that follow

8) Upload the Veteran’s ID

9) Answer the questions that follow

10) Veteran = Yes and VA Healthcare = Yes

11) Electronically sign the ROI Question. (Type in name)

12) Skip all the Healthcare Provider and written Certification portions. (You can’t type in them anyways)

13) There is a voluntary Demographic section.

14) Patient’s Attestation Statement. Check the 3 Statements and type name to e-sign the application

15) Submit Application, (a small window with Barcode Number and mailing address will popup)

16) Supporting documentation

a. VA treatment notes for the claimed condition (Previous 12 Months)

Treatment records can be downloaded from your MyHealtheVet account or by contacting the Fargo VAHCS  "Release of Information" office at 701-239-3700 extentions 3418 or 3419

b. DD214

Request copy of DD214

c. $50 Check with the application Barcode Number written on it.

i. A popup box has the number and mailing address. Barcode also at the top of the application.

d. The DD214, Treatment notes, and $50 Check are mailed into MM Division.

Discharge Requests

Most Veteran’s benefits require that applicants provide a copy of their Form DD 214 or discharge record, which is evidence of their veteran status. This is an important document and must be safeguarded. In the State of North Dakota separation documents are considered confidential and privileged NDCC 37-18-11 (13). National Guard members may receive a NGB22 and/or NGB23 upon obtaining 20 years of satisfactory service (20 year letter).
