Many North Dakotans ask about mask mandates – both to oppose them and advocate for them. The North Dakota Legislature has empowered public health authorities and locally elected school boards to decide questions about mask use and strategies for reducing the rate of COVID-19 transmission. State agencies, including the Department of Health, the Department of Human Services, and the Department of Public Instruction, are ready to provide support and advice for local school boards and public health authorities.

The governor, state school superintendent, other state elected officials, and the state health officer are barred by state law from imposing mask mandates. The law is HB1323, which was approved by the Legislature in April. It is listed in the North Dakota Century Code as 23-07-12.1.
