North Dakota Department of Public Instruction CARES Act Waiver Request to the U.S. Department of Education 

On behalf of the State of North Dakota, the North Dakota Department of Public Instruction (NDDPI) submitted a CARES Act wavier application with respect to the Elementary and Secondary Education Act.

Secretary of Education Betsy DeVos released the application for States to apply for the Coronavirus Aid, Relief, and Economic Security Act (CARES). Through the CARES Act, the Secretary delegates to eligible State educational agencies (SEAs) the authority to waive certain statutory or regulatory education requirements that may impede local efforts to reform and improve education. It is designed to help local educational agencies (LEAs), educational service agencies (ESAs), and schools carry out educational reforms to raise the achievement levels of all children. 

A SEA approved for CARES Act authority may waive certain requirements that apply to Title I Part A, Title I Part C, Title I Part D, Title II Part A, and Title IV
Part A.

The NDDPI believes it would be beneficial to North Dakota schools and districts to pursue this CARES Act waiver.

The U.S. Education Department requires states to provide all districts and interested parties in the state with notice and a reasonable opportunity to comment on this waiver request. We are providing this statewide notice by, posting information in the Weekly Blast, including an article in the NDDPI newsletter, and posting the waiver application on the NDDPI website for three weeks.
