RE: ND Waiver Application for ACT Peer Review Schedule
On behalf of the State of North Dakota, the North Dakota Department of Public Instruction (NDDPI) will be submitting a waiver application request to the U.S. Department of Education (USDE) with respect to the timing and schedule of an approved peer review submission required to allow school districts the flexibility to administer a nationally recognized high school academic assessment.
The US Department of Education stipulates that before a State may approve a nationally recognized high school academic assessment for use by a Local Education Agency, the State must submit evidence to the USDE that demonstrates the locally selected, nationally recognized assessment meets the requirements for peer review under ESEA.
The NDDPI will request a waiver of the requirement for the State to submit, prior to the 2018 administration of the ACT, evidence demonstrating that the ACT meets the requirements of the USDE’s peer review guidance.
The USDE requires states to provide all districts and interested parties in the state with notice and a reasonable opportunity to comment on this waiver request. We are providing this statewide notice by sending an email over the distribution lists and posting the waiver application on the North Dakota Department of Public Instruction’s website. Any public comments must be submitted prior to 5:00 p.m., CT, on November 28, 2017.
Note that North Dakota school districts will not be granted approval to administer the ACT in spring 2018 for accountability if this waiver is not granted by the USDE.
