21st Century Community Learning Centers Tydings Waiver Request
BISMARCK, N.D., April 5, 2016 -- State Superintendent of Public Instruction Kirsten Baesler on Tuesday said the North Dakota Department of Public Instruction (ND DPI) is applying for a 21st Century Community Learning Centers (21st CCLC) Tydings waiver.
The waiver would allow the ND DPI to use 21st CCLC funds that were turned back to the United States Department of Education (USDE). ND DPI is asking for a waiver to use these funds under section 421(b) of the General Education Provisions Act (GEPA) (20 U.S.C. Section 1225(b)) (also known as the “Tydings Amendment”) to extend the period of availability of FY 2012 21st CCLC funds until September 30, 2016 and FY 2013 21st CCLC funds until September 30, 2017.
The USDE requires states to provide all districts and interested parties in the state with notice and a reasonable opportunity to comment on this waiver request. We are providing this notice via email to the Department’s educator distribution lists and will be posting the waiver application on the North Dakota Department of Public Instruction’s public 21st CCLC website. Any public comments must be submitted prior to the close of business Friday, April 22, 2016. The Department of Public Instruction will submit a final waiver application 30 days from April 5, 2016.
