Revised Statement by Kirsten Baesler, North Dakota Superintendent of Public Instruction, About Federal Guidance on Transgender Rights in Schools, May 17, 2016
The North Dakota Department of Public Instruction and North Dakota schools support an environment for students that is safe, free from bullying, and one that helps all students to achieve their fullest potential. We are consulting the lawyer assigned to the Department of Public Instruction from the North Dakota attorney general’s office for advice on what our next steps should be. As state superintendent, I am frustrated with the continuous overreach into education coming from Washington with implied threats of loss of funding for our neediest students.
The law regarding bathroom and locker availability to transgender students is unsettled. Until such time as rights, duties, and obligations are clarified in the courts, we advise our school districts to continue to focus on providing a high quality education to our students, in a caring and respectful environment, and that they continue to work with their students, parents, staff and patrons to ensure the well-being of all who attend or work in the district.
