A notice that must be sent to a household at least 10 days before the effective date of an action that reduces, suspends, or terminates a household’s benefit.

Able to hold a job.

Able-bodied adults between the ages of 18-54 (subject to change) without dependents (ABAWDs) are eligible for participation in SNAP for only three (3) months within a 36-month period of time without working or participating in a work or welfare program for at least 20 hours weekly, averaged monthly, unless exempt. After exhausting the initial three (3) allowable months, ABAWD individuals meeting certain criteria may qualify for three (3) additional months of participation in the 36-month period.

A public or private non-profit abuse shelter that serves abused individuals. If such a facility serves other individuals, a portion of the facility must be set aside on a long-term basis to serve only abused individuals.

Cases that receive SNAP benefits during a calendar month.

The agency shall provide timely and adequate notice before any adverse action is taken. Advance notice requires at least 10 days from the date the notice is mailed to the effective date of the action. Adequate notice must include: the proposed action; the reason for the action; the right to request a fair hearing; telephone number and, if possible, name of person to contact; availability of continued benefits; liability for over issuance if the fair hearing is against the recipient.

Boarders are ineligible to participate in the Supplemental Nutrition Assistance Program (SNAP) separate from the household providing the board. Residents of a commercial boarding house are not eligible for SNAP benefits.

Eligibility to receive these benefits must be based on disability or blindness criteria, which is at least as stringent as SSI regulations. 4.Is in receipt of disability retirement benefits from a government agency because of a disability considered permanent under Social Security disability criteria. 5.Is a veteran with a service connected or non-service connected disability. 6.Is a veteran considered by the VA in need of regular aid and attendance or permanently house bound under Title 38 of the United States Code. 7.Is a surviving spouse of a veteran and considered by the VA in need of regular aid and attendance or permanently house bound or a surviving child of a veteran and considered by the VA as permanently incapable of self-support under Title 38 of the United States Code. 8.Is a surviving spouse or surviving child of a veteran and considered by the VA entitled to compensation for a service-connected death or pension benefits for a non-service-connected death under Title 38 of the United States Code and has a disability considered permanent. Entitled refers to a surviving spouse and surviving children who are receiving the compensation or pension benefits stated or have been approved for such payments but are not yet receiving them. 9.Is in receipt of a Railroad Retirement disability annuity and has been determined to qualify for Medicare. 10.Is in receipt of SSI optional or mandatory supplementation. (North Dakota does not have SSI optional or mandatory supplementation. However, someone moving to North Dakota may have received this benefit from another state.) 11. Is in receipt of disability-based State general assistance benefits, provided that the eligibility to receive any of these benefits is based upon disability or blindness criteria established by the state they receive the benefit from, which are at least as stringent as those used under SSI regulations. (North Dakota does not have disability-based State general assistance benefits. However, someone moving to North Dakota may have received this benefit from another state.)

A formal hearing process conducted by an Administrative Law Judge (ALJ) in which a household or its representatives have the right to further review any action taken on their case. A hearing is conducted, a decision is reached by an ALJ and the household and the Human Service Zone are notified of the decision within prescribed timeframes.

A private or public nonprofit establishment approved by the state (soup kitchen, temporary shelter) that feeds homeless persons. If the shelter is not authorized by FNS, the shelter cannot accept SNAP benefits from the certified residents.

People who buy and prepare food together. Spouses, parents, and children who live together are usually counted as the same household.

Any gain or benefit (goods, services, etc.) which is not in the form of money payable directly to a household. The goods or services may be evaluated to determine a value. This value is considered exempt income in the determination of eligibility and/or benefit.

PARIS is designed to match state enrollment data from TANF, SNAP and Medicaid Programs with data from other participating states and from a select group of federal databases.

Marriages that occur outside of North Dakota are considered valid in North Dakota if: 1. The marriage was legally performed in another state; or 2. The marriage is a common law marriage that occurred in another state and was considered a valid marriage in that state (the couple would be required to provide documentation verifying that the common-law marriage was considered valid by the state in which it took place); or 3. The marriage occurred in another country and the marriage was considered valid according to the law of the country where the marriage was contracted, unless the marriage violates the strong public policy of North Dakota. 4. Polygamous marriages violate the strong public policy of North Dakota. In situations where polygamy has occurred, the first marriage is considered valid in North Dakota if the marriage meets the criteria in numbers 1, 2, or 3 above. Any additional spouse(s) claimed after the first marriage are considered non-relative.

Purchasing a product with SNAP benefits with the intent of obtaining cash or consideration other than eligible food by reselling the product, and subsequently intentionally reselling the product purchased with SNAP benefits in exchange for cash or consideration other than eligible food; or 5. Intentionally purchasing products originally purchased with SNAP benefits in exchange for cash or consideration other than eligible food. 6. Attempting to buy, sell, steal, or otherwise affect an exchange of SNAP benefits issued and accessed via Electronic Benefit Transfer (EBT) cards, card numbers and personal identification numbers (PINs), or by manual voucher and signatures, for cash or consideration other than eligible food, either directly, indirectly, in complicity or collusion with others, or acting alone.
