505 Categorical and Broad Based Categorical Eligibility (BBCE)
Overview
Federal law provides the basic eligibility rules for SNAP. There are two basic pathways to gain financial eligibility for SNAP:

Having income and resources below specified levels set out in federal SNAP law (regular eligibility); or,
-
Being categorically eligible
Any household in which all members receive or are authorized to receive TANF and/or SSI. These households are income and asset eligible. based on receiving benefits from other specified low-income assistance programs.

Traditional Categorical Eligibility (CE) describes households in which all members receive or are authorized to receive SSI or cash assistance funded by TANF, including Diversion Assistance, Transition Assistance, and Kinship Care.

Broad Based Categorically Eligibility (BBCE) describes households in which all members receive or are authorized to receive non-cash assistance (in North Dakota this is the TANF Information and Referral Services brochure).

The following households are categorically eligible Having met the qualifications to receive a SNAP benefit by meeting the specified nonfinancial and financial requirements of eligibility.:
-
Any household
People who buy and prepare food together. Spouses, parents, and children who live together are usually counted as the same household. in which ALL members receive TANF, including Diversion Assistance, Transition Assistance and Kinship Care.

Any household in which ALL members receive SSI, including SSI presumptive eligibility benefits or 1619b.
-
Any household in which ALL members receive TANF and/or SSI.
Receipt of TANF and SSI benefits is defined as:
-
A benefit that was authorized, but not received, or
-
A benefit that was suspended, or
-
A benefit that was recouped, or
-
A benefit not paid because it was less than a minimum amount.

Households in which ALL household members are in receipt of TANF, SSI, or a combination of TANF and SSI are categorically eligible and will automatically pass all asset and income tests.
Exception:When an individual in a SNAP household reports they have received lottery and/or gambling winnings equal to or greater than $4,500, we must close or deny the SNAP case and the household will not be considered categorically eligible.
When a household’s net income exceeds the level at which benefits are provided, the worker must deny the application Filing a signed Application for Assistance via paper application or through the self-service portal of the eligibility system to establish eligibility and assign a review period. using the Notice of Eligibility for denial.
All eligible households consisting of one or two persons are eligible for at least the minimum monthly allotment The total value of SNAP benefits a household is authorized to receive.. Eligible households with three or more members passing the 200% Gross Income Limit (GIL) and 100% Net Income Limit (NIL) tests that are not eligible for a benefit amount are denied or closed.
Exception: If due to proration during the initial month
Any month in which a new application is required. and the benefit is less than $10, the household is eligible for a zero benefit.

Households in which all members receive or are authorized to receive non-cash assistance have broad based categorical eligibility. SNAP households receive TANF I&R services through receipt of the DN 246 – TANF I & R brochure or the DN 405 - Application for Assistance Guidebook or through the Apply for Help Self-Service Portal (SSP). All applicants and recipients are authorized and notified of these services by signing the Application for Assistance or Application for Review Filing a signed Application for Review via paper review form or through the self-service portal of the eligibility system for SNAP eligibility with the human service zone to determine continuing eligibility and establish a new review period. or through the SSP. The Human Service Zone will provide individuals with information and referrals to various other agencies, programs, organizations, and community/Human Service Zone (HSZ) resources that could be of benefit to the household.
Households may include elderly or disabled A member of a household who meets one of the following criteria:
1.Eligible to receive SSI benefits, including presumptive SSI payments, or is eligible as a 1619B under SSI criteria.
2.Is determined disabled by SSA and in receipt of disability payments.
3.Is a recipient of disability related medical assistance under Medicaid (Title XIX of the Social Security Act). Eligibility to receive these benefits must be based on disability or blindness criteria, which is at least as stringent as SSI regulations.
4.Is in receipt of disability retirement benefits from a government agency because of a disability considered permanent under Social Security disability criteria.
5.Is a veteran with a service connected or non-service connected disability.
6.Is a veteran considered by the VA in need of regular aid and attendance or permanently house bound under Title 38 of the United States Code.
7.Is a surviving spouse of a veteran and considered by the VA in need of regular aid and attendance or permanently house bound or a surviving child of a veteran and considered by the VA as permanently incapable of self-support under Title 38 of the United States Code.
8.Is a surviving spouse or surviving child of a veteran and considered by the VA entitled to compensation for a service-connected death or pension benefits for a non-service-connected death under Title 38 of the United States Code and has a disability considered permanent.
Entitled refers to a surviving spouse and surviving children who are receiving the compensation or pension benefits stated or have been approved for such payments but are not yet receiving them.
9.Is in receipt of a Railroad Retirement disability annuity and has been determined to qualify for Medicare.
10.Is in receipt of SSI optional or mandatory supplementation.
(North Dakota does not have SSI optional or mandatory supplementation. However, someone moving to North Dakota may have received this benefit from another state.)
11. Is in receipt of disability-based State general assistance benefits, provided that the eligibility to receive any of these benefits is based upon disability or blindness criteria established by the state they receive the benefit from, which are at least as stringent as those used under SSI regulations.
(North Dakota does not have disability-based State general assistance benefits. However, someone moving to North Dakota may have received this benefit from another state.) individuals, ineligible
Not qualified to receive benefits because of not meeting one or more of the specified nonfinancial or financial requirements of eligibility. students, ineligible aliens, ineligible ABAWD’s, ineligible work registrants, and individuals ineligible due to failing or opting out of providing a social security number.
Exception: The following households are not BBCE (TANF I & R) eligible even if they meet the TANF I & R requirements stated above. These households include a member who is disqualified for an IPV, a member who is a fleeing felon
An individual will be considered a fleeing felon when a Federal, State, or local law enforcement officer acting in his or her official capacity presents an outstanding felony arrest warrant that conforms to one of the following National Crime Information Center Uniform Offense Classification Codes: •Escape (4901); •Flight to Avoid (prosecution, confinement, etc.) (4902); or •Flight-Escape (4999)., a member who with a probation/parole violation, a member convicted of receiving duplicate benefits, a member convicted of trading benefits for weapons, ammunition, explosives or drugs or a member convicted of buying or selling benefits of $500.00 or more. (Households with substantial lottery and/or gambling winnings are not BBCE (TANF I & R) eligible until they meet the asset limit.)

All BBCE (TANF I & R) households must pass the 200% Gross Income Limit (GIL) but are not required to pass the 130% Gross Income Limit (GIL) or the 100% Net Income Limit (NIL).
If the BBCE (TANF I & R) household fails the 200% GIL and includes an elderly or disabled household member, the household is not considered BBCE (TANF I & R) eligible and must be tested a second time under the regular SNAP rules. Regular SNAP rules require that these households pass the asset test and 100% NIL.

There is no asset test for BBCE (TANF I & R) households.
Exception: Households that include a member who is disqualified for the work requirements, a disqualified alien
A legal alien is a person lawfully residing in the United States of America who is not a citizen. A legal alien may not necessarily have permanent residence status. An illegal alien is a person present in the United States of America in violation of the Immigration and Nationality Act., an ineligible ABAWD, or a member who failed to provide a Social Security Number can remain BBCE (TANF I & R) eligible. However, these households must pass the asset test. Only the disqualified household member’s assets are applied to the asset test.

The BBCE (TANF I & R) household’s SNAP benefit amount is calculated by subtracting 30% of the household’s countable net income from the SNAP Thrifty Food Plan Diet required to feed a family in accordance with guidelines established by the U.S. Department of Agriculture. The cost of that diet is the basis for uniform allotments for all households. The thrifty food plan is based on 100% of the federal poverty level. for the household size. 1BBCE (TANF I & R) Households of three (3) or more persons, where 30% of the countable net income exceeds the SNAP Thrifty Food Plan for the household size are not eligible.
All one (1) and two (2) person BBCE households are eligible for the current minimum SNAP benefit except in the initial month if the household is eligible for a zero (0) benefit due to initial month proration of benefits.

Households in which all members receive TANF and/or SSI that also include a member that is disqualified for fraud cannot be categorically eligible. The household will automatically pass the asset test but is subject to the 130% GIL test and 100% NIL test.
Exception: When an individual in a SNAP household reports they have received lottery and/or gambling winnings equal to or greater than $4,500, we must close or deny the SNAP case.

In addition to evaluation at application and application for review, CE and BBCE status must be evaluated when any of the following changes occur:
-
TANF, including Diversion Assistance, Transition Assistance, and Kinship Care, or SSI benefits are terminated.

A household member is disqualified from TANF, including Diversion Assistance, Transition Assistance, and Kinship Care.

A new member is added or removed.
