108 Destitute Migrant and Seasonal Farm Worker
Overview
Migrant A person who moves on a regular basis to find work in harvesting crops or other agricultural activities. or seasonal farm workers who meet the criteria of a destitute household
Migrant or seasonal farm worker households whose only income for the month of application was received prior to the date of application and was from a terminated source. are entitled to expedited services
Certain verification requirements may be postponed for eligible households to allow for prompt issuance of SNAP benefits. even though they may receive income at some other time in the month of application
Filing a signed Application for Assistance via paper application or through the self-service portal of the eligibility system to establish eligibility and assign a review period..

Note: Not all migrant or seasonal farm workers will meet the destitute criteria and these households will be processed under normal procedures. The destitute criterion does not apply to households other than migrant or seasonal farm workers.

A migrant or seasonal farm worker is destitute if:

The only income for the month of application was received prior to the date of application and was from a terminated source. This includes:
-
Income normally received on a monthly or more frequent basis which will not be received again from the same source during the balance of the month of application or the following month.

Income normally received less often than monthly if it will not be received in the month in which the next payment would normally be received
-

The only income to be received in the month of application is from a new source and is:
-
More than $20; and,
-
The income will not be received by the 10th calendar day after the date of application. Income to be received from a new source would include:

Income received on a monthly or more frequent basis if no more than $25 has been received from that source within 30 days prior to the date of application.
Note:Travel advances are not to be considered when determining whether a household
People who buy and prepare food together. Spouses, parents, and children who live together are usually counted as the same household. is destitute, or income is from a new source.

Income received less often than monthly if not more than $25 was received in the last normal interval between payments.

The household may have received both income from a terminated source prior to the date of application and income from a new source after the date of application and be considered destitute if:
-
They receive no other income in the month of application; and
-
Income from the new source is more than $25 and will not be received by the 10th calendar day after application.

Destitute households have their eligibility and benefits calculated for month of application by considering only income which is received between the first of the month and the date of application. Any income that is anticipated from a new source after the date of application is disregarded.
Consider the grower as the source of income for any migrant who is working.
The above procedures apply at initial certification and recertification but only for the first month after certification and recertification.

Sometimes money is received for the expenses of traveling to a new location for employment. These travel advances are considered income if:

The advance of wages will be subtracted from wages later earned by the household; and,
-
The travel advance is, by written contract, an advance of wages. A written contract is defined as:

A written agreement signed by both parties; or
-
A written statement from the employer addressed to the employee at the time of or prior to receipt of the advance stating the advance will be deducted from earnings.

Travel advances that do not meet the definition of income above are to be excluded as a reimbursement.
Travel advances, whether income or a reimbursement, are not to be considered when determining whether a household is destitute or whether subsequent payments from the employer are from a new source of income.

Exclude as income any emergency Public Assistance or emergency General Assistance vendor The person or business who provides goods or services. payments made on behalf of the migrant or seasonal farm worker household while the household is in the job stream. This may include, but is not limited to, vendor payments for housing or transportation.

Migrant and seasonal farm workers receive the full allotment The total value of SNAP benefits a household is authorized to receive. for the month of application when any member of the household has received SNAP benefits within 30 days prior to the date of application (no proration).
