(N.D.A.C. Section 75-02-02.1-17)

 

  1. Medicaid applicants and beneficiaries are not required to apply for other benefits that they may be entitled to as a condition of Medicaid eligibility, including:

    • Annuities

    • Pensions

    • Retirement benefits

    • Disability benefits

    • Unemployment benefits

       

      Example:Other benefits include, but are not limited to, Veterans’ Compensation and Pensions; Old Age, Survivors, and Disability Insurance Benefits; Railroad Retirement Benefits; and Unemployment Compensation.

     

  2. Applicants and recipients are notified these benefits may be available to them to apply for.

     

  3. Application for needs based payments (e.g. SSI, TANF, etc.) cannot be imposed as a condition of eligibility.
