- Evidence of willful withholding of information about income, resources, or circumstances affecting the applicant's benefits.
- Evidence that intentional false statements or misrepresentation of the facts were provided by the applicant.
- The extent that such factors as advanced age, physical and mental limitations, language difficulties, lack of program understanding, et cetera, contributed to the above.
- The extent of the objective factual evidence available and the extent that it can be substantiated, if necessary, in court.
