Federal PIN Eliminates Signature Document for E-Filers

BISMARCK --- State Tax Commissioner Rick Clayburgh today announced that taxpayers who prepare and electronically file their own federal and state individual income tax returns do not need to submit a signature form (Form ND-1OF) or W-2 Wage and Tax statements if they use their federal personal identification number (PIN).

“The Tax Department has received a few calls from concerned taxpayers regarding the signature requirement,” said Clayburgh. “Even though the online service or Turbo Tax software indicates the taxpayer must mail a paper signature document to the Tax Department, this is not always the case.”

The PIN for the federal individual income tax return is the electronic signature for the taxpayer's electronic North Dakota Individual Income Tax Return. Taxpayers who use Turbo Tax software or an online service to e-file their federal and North Dakota Individual Income Tax Return, Form ND-1 can disregard the message to send paper documents to the state tax department when electing to use a federal PIN.

“We are trying to create a paperless process and a system that is as efficient as possible,” said Clayburgh. “Taxpayers using their federal PIN when e-filing their own federal and state returns do not need to send documents such as the signature document (ND-1OF) or their W-2 wage and tax statements.”

“There are two exceptions to this,” said Clayburgh. “If a taxpayer is also filing the Schedule ND-1CR - credit for taxes paid to another state - the taxpayer needs to complete and mail the signature document to the Tax Department along with a copy of the other state’s return and their W-2s.”

Clayburgh added that the other exception is for the e-filer who chooses not to select a federal PIN. In this case, the taxpayer must submit Form 8453 to the IRS, and ND-1OF and the required attachments to North Dakota when e-filing their return.

Several Internet sites are approved to electronically file the North Dakota tax forms and Turbo Tax is the only off-the-shelf software that is approved to e-file the state forms. Clayburgh indicated that the number and type of changes made to the state individual income tax system and forms may have resulted in insufficient time for some companies to program the change in the signature requirement into their product for this year.
