How long must I retain my records?

Under North Dakota Law, records must be retained for a period of not less than three years and three months. These records include, but are not limited to, books of account maintained by a business with all bills, receipts, invoices, cash register tapes, other documents of original entry supporting the entries in the books of account and all schedules or working papers used in the preparation of the tax returns. See the Model Recordkeeping Regulation for further information on the retention of records.

Important note: If it is determined that in a single reporting period a 25 percent discrepancy has occurred, audit assessments can be made in the period the discrepancy occurred. This assessment period extends to six years from the date the return was due or filed, whichever period expires later.
