Seed Labeling Permit System
Any person or company labeling and selling agricultural,
vegetable, flower, or tree and shrub seed in North Dakota is required to obtain
a Seed Labeling Permit and annually report any sales based on tonnage sold.
Additionally, a Non-Resident Seed Dealers license is required if sales are made
directly to the consumer or through an authorized agent.

A Non-Resident Seed Dealer’s License is required if seed is sold to the consumer by direct sales, internet sales, or through an authorized agent. The name and address of each company-authorized agent must be included with the seed dealer’s license. If sales are only made through wholesale or retail businesses in North Dakota, only the seed labeling permit is required.
Annual Report of Seed Sales
Any person labeling agricultural, vegetable, or flower seed in North Dakota is required to submit an annual report and pay a fee on tonnage sold. The reporting period is July 1 through June 30 of each year. Payment is due 31 days after the end of the reporting period. Only seed sold with your name as labeler must be reported.
Agricultural seed means the seed of grass, forage, cereal, fiber, oil crops, Irish potato seed tubers, and any other kind of seeds commonly recognized within this state as agricultural seed, lawn seed, and mixture of these seeds.

Cereal grains (bulk or bagged) …$0.02 per cwt
Flax, soybeans, field beans, field peas (bulk or bagged)…$0.04 per cwt
Other agricultural seed sold in bulk…$0.06 per cwt
Other agricultural seed sold in containers up to 160 pounds:
Vegetable and flower seed…$0.50 for each $25 wholesale value
