Dear Colleague:

I am writing to ask your assistance in helping Social Security get important information to certain State and local entities that are affected by a new provision of the law.

Section 419(c) of Public Law 108-203, the Social Security Protection Act of 2004 requires State and local government employers to disclose the effect of the Windfall Elimination Provision and Government Pension Offset Provision to employees hired on or after January 1, 2005 in jobs not covered by Social Security. These employees also must sign a statement that they are aware of a possible reduction in their future Social Security benefit entitlement.

I would appreciate your help in sharing this information with public employers who need to know about this new provision of the law, especially those individuals involved in hiring new employees.

Form SSA-1945, Statement Concerning Your Employment in a Job Not Covered by Social Security , is the document that new employees should sign.
