Before applying for a resident bail bonds license, an individual must take and pass the bail bonds exam. North Dakota law does not require classroom instruction for an applicant preparing for the examinations. Preparation can be done by classroom instruction or self-study and applicants will not have to provide verification of study to the North Dakota Insurance Department or the testing center.

Study material and classroom schedules can be obtained from a number of prelicensing providers. North Dakota does not require prelicense instruction; therefore, the information and materials given by prelicense providers are not approved or regulated. The Department cannot recommend one provider over another.

It is important to ensure you answer all questions completely and disclose all requested information. You must disclose all criminal convictions and pending criminal charges. Question number one allows you to exclude misdemeanor traffic citations or convictions involving driving under the influence (DUI) or driving while intoxicated (DWI), driving without a license, reckless driving or driving with a suspended or revoked license and juvenile offenses. You must disclose all other criminal convictions and pending charges including, but not limited to, NSF checks and Minor in Possession. These criminal convictions must be disclosed regardless of when they occurred. See Bulletin 2009-2 for more information. If you have any questions about what needs to be disclosed, contact the Department before submitting your application.

Once you have passed the examination, you can apply for your resident license by submitting an application and paying the $100 fee.
 
Non-resident individuals must hold a similar license in their resident state and should apply through the National Insurance Producer Registry (NIPR).

N.D.C.C. § 26.1-02.1-02.1 prohibits a person convicted of a felony involving dishonesty or breach of trust from participating in the business of insurance. A license cannot be issued to anyone with this type of conviction. Failure to make full disclosure may result in denial of your application.
 
Bail bond individual producers have a biennial license renewal on their birth month. Individuals may submit a renewal through NIPR. The renewal fee is $25 and the transaction fee is $5.

Business Entity

Applicants for a business entity North Dakota insurance producer license should apply through the National Insurance Producer Registry (NIPR). The fee for an initial application for an insurance producer license is $100. At least one individual who is affiliated with the business entity must hold a North Dakota license for the lines of authority requested.

The business entity should also contact the North Dakota Secretary of State to ensure compliance with North Dakota corporate law.

North Dakota business entity insurance producer licenses are perpetual without any renewal or continuation as long as the entity:

  • Has at least one designated responsible licensed producer (DRLP) who holds an active North Dakota insurance producer license for the lines of authority on the business entity license; and
  • Maintains its resident insurance producer license (if its home state issues insurance producer licenses to business entities); and
  • Notifies the North Dakota Insurance Department of any change of address regarding the business entity within 30 days in accordance with N.D.C.C. § 26.1-26-33.
