Wage and Hour Division
The North Dakota Department of Labor and Human Rights is responsible for enforcing wage and hour laws such as minimum wage, overtime, breaks, and youth employment. In addition, the department resolves wage disputes between employees and employers and has authority to collect unpaid wages.
The wage and hour laws enforced by the department can be found throughout N.D.C.C. Title 34 and N.D. Administrative Code Chapter 46-02-07. A summary of these provisions can be found on the latest version of the ND Minimum Wage & Work Conditions Summary Poster.
To report possible labor law violations related to breaks, youth employment, applicability of overtime, receipt of final paycheck, etc., please utilize the complaint inquiry process.
If you believe you are entitled to wages that were not paid to you, you may file a Claim for Unpaid Wages with the department by completing the wage claim process.
