Wage & Hour Division

The North Dakota Department of Labor is responsible for enforcing wage and hour laws such as minimum wage, overtime, breaks, and youth employment. In addition, the department resolves wage disputes between employees and employers and has authority to collect unpaid wages.

The wage and hour laws enforced by the department can be found in N.D.C.C. Title 34 and N.D. Administrative Code Chapter 46-02-07 - [34 kb pdf document]. A good summary of these provisions can be found on the latest version of the ND Minimum Wage & Work Conditions Summary Poster - [69 Kb pdf document].

If you are concerned about possible labor law violations related to your employment, you may report them to the department by completing the Complaint Inquiry Form.

If you believe you are entitled to wages that were not paid to you, you may file a Claim for Unpaid Wages with the department by completing the wage claim process.

If you are an employer and have questions regarding your rights and responsibilities under state labor laws, please contact us.
