Human Rights DivisionDiscrimination in Public AccommodationsThe North Dakota Human Rights Act (N.D.C.C. Chapter 14-02.4) prohibits discrimination in the provision of public accommodations. Public accommodations are defined as "every place, establishment, or facility of whatever kind, nature, or class that caters or offers services, facilities, or goods to the general public for a fee, charge, or gratuity." It does not include "a bona fide private club or other place, establishment, or facility which is by its nature distinctly private; provided, however, the distinctly private place, establishment, or facility is a 'public accommodation' during the period it caters or offers services, facilities, or goods to the general public for a fee, charge, or gratuity." It is a discriminatory practice to fail to provide access to public accommodations or to give unequal treatment in the provision of public accommodations because of a person's race, color, religion, sex, national origin, age (forty or older), physical or mental disability, marital status, or receipt of public assistance. The Human Rights Division is responsible to receive and investigate complaints alleging discrimination in public accommodations. If you feel you have been discriminated against in the provision of a public accommodation, complete the Human Rights Intake Questionnaire form and submit the completed form to the division. If you wish to report what you believe to be noncompliance with laws relating to discrimination in public accommodations but do not wish to seek a remedy for yourself, complete the Complaint Inquiry form and submit the completed form to the division.
