Housing Discrimination

The Division of Human Rights is responsible for receiving and investigating complaints alleging unlawful housing discrimination under the North Dakota Housing Discrimination Act (N.D.C.C. Chapter 14-02.5). The act prohibits discrimination in the sale or rental of housing because of a person's race, color, religion, sex, disability, age, familial status, national origin, or status with respect to marriage or public assistance.

The North Dakota Housing Discrimination Act was deemed by the federal Department of Housing and Urban Development (HUD) to be "substantially equivalent" to the federal Fair Housing Act in September 2000. This status allows the Division of Human Rights to contract to conduct investigations for the federal agency. Under the contract, all cases filed with either agency are filed under both state and federal laws and a single investigation is conducted by the Division of Human Rights.

To file a housing discrimination complaint, complete the Housing Discrimination Questionnaire (State Form 52229) [134 kb pdf document] and submit the completed form to the department.
