Complaint Inquiry ProcessPersons who believe they have been harmed by a discriminatory practice or are entitled to wages they have not received may file formal complaints with the Department of Labor to seek remedy for those specific actions. In addition, anyone who wishes to report incidents of noncompliance with any labor standards provision or human rights law may do so by completing a Complaint Inquiry form. Upon receipt of a completed complaint form, the department will contact the employer, housing provider, or service provider by letter, telephone, or in person. We will discuss the nature of the concern with the party, provide an opportunity for him or her to respond, and advise him or her of the legal requirements related to the issue. If it is determined that there has been a violation of state law, we will work with the party to correct the situation. We understand that anonymity is a consideration in reporting such concerns. It is the policy of the department to maintain the confidentiality of complainants. This means that we will not automatically disclose your name when contacting a party against whom a complaint has been filed. However, there are circumstances under which we are legally unable to avoid disclosing the identity of a complainant. Be advised that North Dakota law prohibits retaliation against persons who file complaints with the department. All parties to complaints filed with the department are advised of anti-retaliation laws. The department will address all complaints as quickly as possible in the order that they are received.
