alternative dispute resolution - Mediation

Mediation - A Sure Way to Solve Conflict - It Can Work For You!!

Human Resource Management Services (HRMS) offers mediation services to state agencies as an alternative method of resolving workplace disputes. Employees, supervisors, or directors can contact HRMS to initiate this service or to inquire further about the process.

Mediation is a voluntary, confidential dispute resolution process that requires commitment of the parties to attempt to settle a dispute with the assistance of a neutral, skilled, impartial third party - the mediator. The process involves assisting parties collectively and privately to identify the issues in dispute and develop proposals to resolve conflict in a way that best serves the interest of both parties.

The role of the mediator is deliberate to help the parties diffuse the feelings that are often involved in a dispute, encourage compromising discussion, and, as possible, create an agreement that will be useful to both parties. The mediator has an obligation to the parties and the profession to uphold ethical standards. The mediator is not the "decision maker" but assumes the position of facilitator, probing and offering insights or suggestions to the parties regarding his or her thoughts of the issues in dispute, only if both parties consent to have the mediator do so. HRMS mediators are trained in the dynamics of human conflicts, negotiation theory, techniques of mediation, ethics, drafting of party agreements, and communication skills. Mediators are committed to devoting as much time as needed to assist parties in finding solutions.

The use of mediation has increased substantially in the public sector as employees and supervisors are developing more certainty of this means to effectively and inexpensively solve discord and foster a harmonious working relationships.

Some of the benefits of mediation are:

  • Convenient - Appointments are tailored to fit the schedule of parties involved.
  • Efficient - Rapid settlements are possible through discussions with the parties.
  • Improved Work Relationships - With disputes resolved, the future working relationship is strengthened, thus supporting improved productivity of all concerned.
  • Creating Resolutions - Parties work out solutions they can live with and trust.
  • Cost Effective - Parties applying this process generally reduce both emotional and time costs - management sees cost effectiveness through reduced formal litigation.
