ADA/FMLA - What's the Same? What's Been Changed? How Do They Interact?
Course Contents
This training is highly recommended for any employee who supervises individuals within their department. In January and February 2009 respectively, the Americans With Disability Act (ADA) and Family and Medical Leave Act (FMLA) changed significantly. Individuals with disabilities who were once excluded from coverage are now protected and individuals requesting FMLA leave can receive leave beyond immediate family members and for themselves. Attendees will learn:
• The qualification standards for both laws
• The role essential functions play in both laws
• The expanded leave protection under both laws
• How to determine if the employee is qualified for leave under either law
• When an employer is allowed to transfer an employee to an alternate position
• The role the medical exam plays in determining if an individual is protected under either law
• When an employer is required to offer a light duty job
• How the two laws interact and how individuals can be protected by just one law or both laws at the same time
• What steps need to be taken when an employee asks for FMLA or ADA leave
• The role of the employer and employee when leave is requested under either law
