Grievance/Complaint Procedure

If you believe you have been denied access to voting or had a difficult experience accessing the polling location and/or voting process, you have a right to file a complaint. Title III of the Help America Vote Act required states to have a complaint process for persons who feel, because of a disability, they were denied access to the voting process. In North Dakota, the complaint is submitted directly to the Secretary of State for review and action. Persons wishing to file a complaint need to submit, in writing, a notarized, signed and sworn account of the violation to the North Dakota Secretary of State. Once received, the Secretary of State has 90 days to determine if a violation of Title III has occurred and define the action to be taken, if it is decided a violation has occurred.
