The Education Standards and Practices Board (ESPB) meeting was called to order at 8:01 am by board chair, Mike Heilman. Board members who attended were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Others who attended the meeting were Mari Fridgen, Diane Weber and Janet Welk from ESPB, LeAnn Nelson from ND United, Matt Strinden and Ryan Townsend from DPI and Sandra Voller from the AG’s Office.

Kimberly Belgarde made the motion to add Beth Ekre, Mary Ellen Homan, Gaylene Parisien and Brad Larson as cases. Second by Karen Christensen. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and TimTausend.

Rod Jonas made the motion to approve the February, 2014 minutes. Second by Laura Mihalick. Motion carried. Board members who voted in agreement were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend.

A motion was again made by Rod Jonas approving the February, 2014 financial report and licensure report. Second by Tim Tausend. Motion carried. Board members who voted in agreement were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. The February financial statement showed $42.775.48 in total income received, $53,022.28 total expenses, with a minus income of $10,246.80. February, 2014 licensure report showed 670 total licenses and/or endorsements issued.

Reprogramming has been started by Nexus, Innovations. The new programming will include the late fees and minor software changes. Nexus quoted a price of $28,000 for the new programming.

Reimbursements have been given to 20 candidates for the core academic skills pilot project.

North Dakota Council of Educational Leaders (NDCEL) new building project update was provided by Aimee Copas.

Mari Fridgen and Amy Folkestad have been providing on site visits to education preparation programs and common core information at the following institutions: Dickinson State, Jamestown University, Valley City State University, North Dakota State University and Minot State University.

Amy Mann attended the mentoring New Teacher Center Symposium in February. She expressed her appreciation in attending the symposium. She extended a big thank to Laurie Stenehjem in her leadership role with the North Dakota mentoring program.

ETS multistate validation reports were received. A motion was made by Rod Jonas to accept the Praxis Middle School Science 5440 test recommended cut score of 150. Second by Tim Tausend. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. A motion was again made by Rod Jonas to accept the Praxis Elementary Education: Curriculum, Instruction and Assessment 5017 test recommended cut score of 153. Second by Amy Mann. Motion carried. Board members voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Test 5017 replaces 5011. Mary Eldredge-Sando made the motion to accept Praxis Elementary Education: Instructional Practice/Application 5019 test recommended cut score of 155. Second by Karen Christensen. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. A motion was made by Mike Bitz to not accept the Praxis Elementary Education: Read/Language Arts subtest 5002 recommended cut score of 157 and Mathematics subtest 5003 recommended cut score of 157. Second by Mary Sandbo-Eldredge. Motion carried.

CASES
ANDERSON, EMILY
Ms. Anderson’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13.25 (1) (j). Rod Jonas made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Karen Christensen. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Anderson is an elementary teacher with Williston Public Schools.

ALESHIRE, TODD
Mr. Aleshire’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Mike Bitz made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $50 fine. Second by Kimberly Belgarde. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend.

BIVER, MICHELLE
A motion was made by Rod Jonas to grant an initial, two year in-state-educator license. Second by TimTausend. Motion carried. Board members who voted in favor were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Biver’s application was before the Board due to her
background check.

CONNICK, BRYCE
Mr. Connick’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Kimberly Belgarde made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Rod Jonas. Board members who voted in agreement were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Mr. Connick is a physical education instructor with May-Port CG Middle-High School.

DELGADO-NELSON, DORCAS
Ms. Delgado-Nelson’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j) and teaching outside her qualifications of the law. Karen Christensen made the motion that Ms. Delgado-Nelson needs to immediately cease her unlawful practice to avoid disciplinary action. Mr. Routledge, principal of Bishop Ryan Catholic Schools will also be contacted stating such and he is to contact the ESPB office regarding the options for the school. Second by Mike Bitz. Motion carried. Board members who voted yes were Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Kimberly Belgarde did not vote. Ms. Delgado-Nelson is currently on an alternate access license. She has not completed the coursework which is required to maintain the license. She is currently teaching Spanish at Bishop Ryan Catholic Schools in Minot.

DOUGLAS, JOSHUA
Mr. Douglas’ license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). The office contacted the principal where Mr. Douglas is teaching, asking to describe how Mr. Douglas was supervised and who provided the supervision. The correspondence has been provided, therefore a motion was made by Mary Eldredge-Sandbo to dismiss. Second by Amy Mann. Motion carried. Board members who voted in agreement were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Mr. Douglas is employed as a social studies teacher with Martin Luther School in Bismarck. He has been employed at the school since August, 2013 and obtained a five year OSEL license in December, 2013.

EKRE, BETH
Ms. Ekre’s license was before the Board because she was teaching outside of her qualifications/field from August 1, 2011 to January 28, 2014 in violation of NDCC 15.1-13-17 and 18. A motion was made by Rod Jonas to proceed with formal disciplinary action and offer a settlement agreement of $250 fine. Second by Karen Christensen. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Mike Heilman voted no. Mary Eldredge-Sandbo did not vote. Ms. Ekre is teaching social studies at Carl Ben Eielson Middle School in Fargo. Ms. Ekre did not have an updated TAFE plan on file. Ms. Ekre is a license elementary teacher holding a middle school endorsement.

HARTJE, TARA
Ms. Hartje’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Mike Bitz made the motion to proceed with disciplinary action and offer a settlement agreement of a $100 fine. Second by Rod Jonas. Motion carried. Board members who voted in favor were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Hartje is employed with Cavalier Public Schools as an elementary teacher.

HEID, DAPHNE
Ms. Heid’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Rod Jonas made the motion to dismiss. Second by Tim Tausend. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Heid teaches math and technology education courses at Marmot Schools in Mandan.

HOCHHALTER, KREGG
Rev. Hochhalter’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1(j). Mike Bitz made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Kimberly Belgarde. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Laura Mihalick and Loni Miller. Board members Amy Mann and Tim Tausend voted no. Rev. Hochhalter is teaching theology at Trinity High School in Dickinson.

HOMAN, MARY ELLEN
Ms. Homan’s license was before the Board because she was teaching outside of her qualifications /field and is in violation of 15.1-13-17 and 18. A motion was made by Rod Jonas that Ms. Homan needs to immediately cease her unlawful practice and work on a plan to get back on track. The director and assistant director at SE Region Career/Tech Center will be contacted stating such and they are to contact the ESPB office regarding the Center’s options. Second by Mike Bitz. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Homan is licensed as an elementary education instructor.

JAEGER, TRACY
Ms. Jaeger’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). A motion was again made by Rod Jonas to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Karen Christensen. Motion carried. Board members who voted in agreement were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Jaeger is employed with Washburn Public Schools as an elementary teacher.

MAXON, TYSON
A motion was made by Rod Jonas to grant an initial, two-year license. Second by Karen Christensen. Motion carried. Board members who voted in favor were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Mr. Maxon’s license application was before the Board due to his background check.

PARISIEN, GAYLENE
Ms. Parisien’s license was before the Board because of potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Laura Mihalick made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Karen Christensen. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann, Laura Mihalick, Loni Miller and Tim Tausend. Ms. Parsien is employed at Turtle Mt. Community School in Belcourt as an elementary teacher.

STOREY, ROBERT
Mr. Storey’s license was before the Board due to potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1-13-25(1)(j). Tim Tausend made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Laura Mihalick. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Laura Mihalick, Loni Miller and Tim Tausend. Amy Mann voted no. Mr. Storey teaches theology at Trinity High School in Dickinson.

WITTICH, THERESA
Ms. Wittich’s license was before the Board due to potential violation for teaching without a license in violation of NDCC 15.1-13-17 and 15.1.13-25(1)(j). A motion was again made by Rod Jonas to proceed with formal disciplinary action and offer a settlement agreement of a $100 fine. Second by Kimberly Belgarde. Motion carried. Board members who voted in favor were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Laura Mihalick, Loni Miller and Tim Tausend.

ADMINISTRATIVE BOARD
LARSON, BRAD
Mr. Larson’s license was before the administrative board because he knowingly permitted a teacher to teach outside of her qualifications/field in violation of NDCC 15.1-13-17 and 18. A motion was made by Mike Bitz to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine. Second by Karen Christensen. Motion carried. Administrative board members who voted yes were Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Laura Mihalick and Tim Tausend. Mr. Larson is the principal at Carl Ben Eielson Middle School in Fargo.

The Board reviewed the 2013-14 Administrative Rules. The language changes include the following: changing fines to late fees, Praxis test codes/scores removal, allowing an elementary prepared teacher to move up to secondary education by taking the secondary test and/or allowing the secondary prepared teacher to move down to elementary education by taking the elementary test and recognizing other state education licensee endorsements. A public hearing was held on January 24, 2014, with written comments until February 7, 2014. No oral or written comments were received. A motion was made by Rod Jonas to approve the final 2013-14 Administrative Rules as written. Second by Mary Eldredge-Sandbo. Motion carried. Board members who voted yes were Kimberly Belgarde, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Laura Mihalick, Loni Miller and Tim Tausend. It is hoped the rules will become effective by fall of 2014.

The next Joint Board meeting is scheduled for June 25, 2014. ESPB will be the host.

The meeting was adjourned at 11:30 am.
