The Education Standards and Practices Board (ESPB) meeting was called to order by vice-chair, Nick Archuleta.   Board members who attended were Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, and Marlene Srock.  Others who attended the meeting were Diane Weber and Janet Welk from ESPB, Matt Strinden from DPI,  Daphne Ghorbani from University of Mary,  Al Olson from Valley City State University, Sandra Voller from the AG’s Office, Doug Johnson from NDCEL and LeAnn Nelson from NDEA.

Board members Greg Allen, Angela Korsmo and Amy Mann did not attend the meeting.    

A motion was made by Rod Jonas approving the February, 2013 minutes.  Second by Mike Bitz. Motion carried. Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock. 

Rod Jonas made a motion approving the February, 2013 financial report.  Second by Mike Bitz.  Motion carried.   Board members who voted in favor were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  The February financial statement showed $69, 911.90,   total  revenue  received, $76,425.50 total expenses with a net income of a minus $6,513.60.  The February licensure report showed 643 total licenses issued.

Rod Jones made a motion approving the 2011 audit report.  Second by Mike Bitz.  Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Rod Jonas and Marlene Srock.  Mike Heilman was not present when the voting took place.

Board cases which were added were David Gourneau, Sr and Cathy Pyle.

Doug Johnson provided a legislative recap.

Al Olson and Daphne Ghorbani provide a presentation on their participation with ETS multistate validation study for the Praxis Core Academic Skills for reading, writing and math. They felt freshman/sophomores might have difficulty with the writing essay portion.  There are two essay questions where the panelists outline their thoughts and structure for writing without being required to write all the words in the 30 minute time allotment.  Much discussion was also done on when to implement the new cut scores.  The Board suggested a pilot study with a mixture of teacher candidate randomly selected with various majors from various North Dakota institutions.  ESPB would pay the testing fees.  Janet will contact ETS to see if this can be done. 

Janet provided a draft on the elementary education endorsement rewrite, which includes the student teaching component.  The elementary endorsement rewrite will be part of the administrative rules process.

CASES
Amundson, Allison
The Board was called into executive session at 1:26 and reconvened at 1:36.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Mike Bitz to issue an initial, one-year interim substitute.  Second by Rod Jonas.  Motion carried.  Board members who voted yes were Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Karen Christensen voted no.  Ms. Amundson’s online application request was before the Board due to her background check.

Clayton, Karen
The Board was called into executive session at 1:26 and reconvened at 1:36.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Rod Jonas to not grant an Alternate Access license in counseling.  Second by Mike Heilman.  Motion carried.  Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Ms. Clayton’s online license request was before the Board because of her background check.  She is still on probation.

Forness, Sara
A motion was made by Rod Jones to proceed with formal disciplinary action against her license and offer an informal settlement agreement of a $100 fine.  Second by Karen Christensen.  Motion carried.  Board members who voted yes were Mike Bitz, Karen Christiansen, Mike Heilman and Rod Jones.  Board members who voted no were Nick Archuleta, Mary Eldredge-Sandbo and Marlene Srock.  Ms. Forness is employed at West Fargo Public Schools as a science teacher.  NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

Gilbertson, Erica
A motion was made by Rod Jonas to proceed with formal disciplinary action against her license and offer an informal settlement agreement of a $100 fine.  Second by Mike Heilman.  Motion carried.  Board members who voted in favor were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Ms. Gilbertson is employed Bishop Ryan Catholic School in Minot as a guidance counselor.  NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

Hicks, Caitlin
The Board was called into executive session at 1:26 and reconvened at 1:34.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Mike Heilman to grant a two-year, out-of-state reciprocal license.  Second by Mike Bitz.  Motion carried.  Board members who voted in favor were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Ms. Hicks’ online license request was before the Board due to her background check.

Hundeby, Joseph
The Board was called into executive session at 1:26 and reconvened at 1:34.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Mike Bitz to grant a five-year, OSEL.  Second by Rod Jonas.  A motion carried.  Board members who agreed were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.

Kern, Joseph
Mike Heilman made the motion to proceed with formal disciplinary action against his license and offer an informal settlement agreement of a $100 fine. Second by Rod Jonas.  Motion carried.  Board members who voted in agreement were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Mr. Kern is employed at Lisbon Middle School as social studies and language arts instructor.  NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

Pyle, Cathy
A motion was made by Rod Jonas to deny Ms. Pyle’s request to change her license from a five-year license to a 30-year life license.  Second by Mike Heilman.  Motion carried.  Board members who agreed were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman and Rod Jones.  Marlene Schrock voted no.  Ms. Pyle’s five-year license will expire in April, 2014. 
Ms. Pyle indicated she does not have the four semester hours for renewal.

Richardson, Cody
The Board was called into executive session at 1:26 and reconvened at 1:34.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Rod Jonas to grant a two-year, initial license.  Second by Karen Christensen.  Motion carried.  Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock. 

Schaan-Eszlinger,  Darcy
Mike Heilman again made the motion to proceed with formal disciplinary action against her license and offer an informal settlement agreement of a $100 fine.  Second by Mike Bitz.   Motion carried.   Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mike Heilman and Rod Jones.   Board members who voted no were Mary Eldredge-Sandbo and Marlene Srock.  Ms. Eslinger-Schaan is employed with Grafton Public Schools as a science instructor.  NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

Schultz, Jennifer
Mike Bitz made the motion to revoke Ms. Schultz’s license.  Second by Mike Heilman.  Motion carried.  Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Ms. Schultz’s license was before the Board because she was found guilty of offenses having direct bearing on her ability to serve as an educator.  Ms. Schultz was formerly employed with Hebron Public Schools as a home economics instructor.  NDCC 15.1-13-25(1)(d)(e) and ND ADM Code  67.1-03-01-02(3)(6)

Sifuentes, Tony
The Board was called into executive session at 1:26 and reconvened at l:34.  The purpose of the closed meeting was to discuss personal information contained in the file.  A motion was made by Rod Jonas to grant a one-year, interim substitute license.  Second by Mike Heilman.  Motion carried. Board members who voted yes were Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jones and Marlene Srock.

Yellow Bird, Delilah
A motion was made by Rod Jonas to proceed with formal disciplinary action against her license and offer a settlement agreement of a $100 fine.  Second by Mike Bitz.  Motion carried.   Board members who voted in agreement Nick Archuleta, Mike Bitz, Karen Christensen, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas and Marlene Srock.  Ms. Yellow Bird is employed at White Shield Public Schools as a Native language instructor.  NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

ADM CASE
Gourneau David, Sr.
A motion was made by Mike Bitz to grant Mr. Gourneau’s request and issue a 30-year life license.  Second  by Mary Eldredge-Sandbo.  Motion carried.  Administrative board members who voted yes were Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Rod Jonas and Marlene Srock.  Mike Heilman voted no.   Mr. Gourneau was not aware of the 30-year life license when he renewed his five-year license in November, 2012.
