The Education Standards and Practices Board (ESPB) meeting was called to order by board chair, Greg Allen. Board members who attended were Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy. Others who attended the meeting were Diane Weber and Janet Welk from ESPB, Connie Mittleider from DPI, Shawn Huss from the Wilmac Special Ed Unit in Williston, Bill Peterson from the AG’s office, Della Thorson and Bandi Fagerland from ITD, Shelley Earsley from Eide Bailly, Aimee Copas from NDSU and Karen Christiansen.

Introductions were held and a welcome extended by Greg Allen.

Angela Korsmo made the motion to added Kara Four Bear and Cornell Kilber to the agenda as board cases. Second by Amy Mann. Motion carried. Board members who voted yes were Greg Allen,
Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann.

Eide Bailly performed a business process review for ESPB for the purpose of gaining a clear understanding of business processes and use of technology, providing recommendations for future processes and resource needs, and offering suggestions for efficiency gains and enhance the use of the ND Teach system. Janet is to move ahead with implementing the changes suggested and report back to the Board which processes have been implemented. Rod Jonas made the motion, as of March 1, 2013, all licenses and renewals are to be submitted thru electronic means via the online system. Second by Nick Archuleta. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann.

Mike Bitz made a motion to seek emergency status and seek the Governor’s assistance, prior to the administrative rules approval for the following: when a shortage of subs exist, sub must have a minimum of two years of post-secondary education, late fee instead of fine, TAFE and alternative access teaching experience of no less than two years. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann.

Janet also informed the Board that interviews were being done for the Accountant/Data Entry position. It is hoped to have the new individual start the early part of September.

Aimee Copas provided information on Higher Education/Common Core State Standards.

A motion was made by Nick Archuleta to approve the June retreat, 2012 minutes with stated corrections. Second by Angela Korsmo. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann.

Rod Jonas then made the motion approving the June 2012 and July 2012 financial report. Second by Angela Korsmo. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann. The June 2012 report showed total income of $109,607.04, total expenses $89,607.97 with a net income of $19,999.07. National board $24,000.00 reimbursement was not reflected in the net income. The July 2012 report showed total income received was $79, 955.44, total expenses $82,940.52 and a net income of a minus $2,985.008. Reimbursement of $4,822.50 for Nexus and reimbursement for National Board of $1,250 was not captured at this time.

A motion was made by Nick Archuleta to approve the 2012 license manual code. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sando, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann. Approval of the manual aligns all majors based on standards. The majors appear on the second page of every license. The second page indicates what areas the educator can teach.

Rod Jonas made the motion to accept the recommended passing score of 154 for PRAXIS Special Education: Teaching Students/behavioral Disorders and Emotional Disturbances. Second by Nick Archuleta. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann.

CASES
CARROLL, JASON
Nick Archuleta made the motion to initiate disciplinary action and offer a settlement agreement of a letter of reprimand. Second by Mary Eldredge-Sandbo. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman and Amy Mann Rod Jonas was not present when the voting took place. Mr. Carroll’s license was being reviewed by the Board due to a request for inquiry which was filed. Mr. Carroll is employed with Edgeley Public Schools as an elementary and physical education instructor. NDCC15.1-13-25(1)(j) and ND Adm. Code 67.1-03-01-02(3)

FOUR BEAR, KARA
Nick Archuleta made the motion to issue a two-year, other state educator license. Ms. Four Bear’s license application was before the Board because of her background check. Second by Mike Bitz. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary-Eldredge-Sandbo, Mike Heilman, Angela Korsmo and Amy Mann. Rod Jonas was not present when the voting took place.

GARTNER, MELISSA
A motion was made by Nick Archuleta to dismiss the case. Second by Mike Heilman. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo and Amy Mann. Rod Jonas was not present when the voting took place. Ms. Gartner’s file was before the Board due to a possible fine. She is employed Mandan Public Schools as math/science instructor.

KILBER, CORNELL
Much discussion was held by the Board. A motion was made by Rod Jonas for the office to obtain attorney’s argument in the court case and the school’s decision of findings/facts/order. Second by Angela Korsmo. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mary Eldredge-Sandbo, Angela Korsmo and Amy Mann. Mike Bitz did not vote and Rod Jonas was not present when the voting took place. Mr. Kilber was formerly employed with the Grand Forks Public School system.

KITTELSON, MATTHEW
Mike Bitz made a motion to issue an initial, two-year license. Second by Angela Korsmo. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo and Amy Mann. Rod Jonas was not present when the voting took place. Mr. Kittleson’s license was before the Board because he checked yes to question #3, part 1 of the license application.

SCALLON, BEN
Angela Korsmo made the motion to issue an initial, two-year license. Second by Nick Archuleta. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas and Amy Mann. Mr. Scallon’s online application was before the Board due to his background check.

TOSNER, JENNIFER
A motion was made by Mike Heilman to proceed with disciplinary action and offer a settlement agreement of a $250 fine. Second by Mike Bitz. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo and Amy Mann. Rod Jonas was not present to vote. Ms. Tosner’s license was before the Board because she was engaged in the profession of teaching while not holding a current license. She is employed with Twin Buttes Elementary School. NDCC 15-1-13-25(1)(h) and 15.1-13-17(1)

VARHOLDT, JAMIE
Angela Korsmo made the motion to issue a two-year, other state education license. Second by Mary Eldredge-Sandbo. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, and Mike Heilman. Angela Korsmo, Rod Jonas and Amy Mann. Mr. Varholdt’s license application was before the Board due to his background check.

WILLIAMS, SARAH
The Board took no action.

The meeting was adjourned at 3:00.
