The Education Standards and Practices Board (ESPB) meeting was called to order by vice- chair, Greg Allen. Board members who attended were Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Others who attended the meeting were Diane Weber and Janet Welk from ESPB, Bill Peterson from AG’s Office and Kayla Pulvermacher from NDEA.

Don Paulsrud did not attend the meeting.

Angela Korsmo made a motion to add board cases Scott Neumann, Michelle Deichert and Julie Woodbury to the agenda. Second by Marlene Srock. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock.

Mike Bitz made the motion approving the February, 2012 minutes. Second by Nick Archuleta. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jones, Amy Mann and Marlene Srock.

A motion was then made by Mike Heilman approving the February, 2012 financial report. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. The February financial statement showed $62,221.09 in total income, $49155.86 total expenses, with a net income of $13,065.23.

The Board reviewed the July 1, 2012 administrative rules draft. The Board did a two part final adoption of the rules. One part being the “obsolete” which will be presented to the Rules Committee on March 14th. A motion was made by Mike Bitz to declare the current rules obsolete. Second by Angela Korsmo. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. With HB 1270 the following administrative rules have become obsolete and have lost their usefulness:

  1. Section 67.1-02-02-02, (1)(b) paragraph 6—removing the special education double major.
  2. Section 67.1-02-02-02 (3)-- removing the three recommendations
  3. Section 67.1-02-02-02 (6)(b)—removing college placement file
  4. Section 67.1-02-02-3—removing the entire distance learning instructor-definition-qualifications-licensure.
  5. Section 67.1-02-02-04(1)(a)paragraph2—removing recommendations from 2 year renewal
  6. Section 67.1-02-02-04(2)(a) paragraph 3--removing recommendations from 5 year renewal
  7. Section 67.1-02-02-04(2)(d)—delete entire subdivision removing when recommendations are not adequate to issue a 5 year, provide a hearing
  8. Section 67.1-02-02-05 (2) –removing additional recommendation wording
  9. Section 67.1-02-02-06(3)—failure to submit appropriate recommendations

Mike Heilman made a motion approving the remaining administrative rules. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock.

Discussion was held regarding an RFP for ETS testing services verses Pearson testing services. Rod Jonas was the spokes person from NDACTE. NDACTE does not what to switch from ETS testing to Pearson testing. A motion was made by Mike Bitz to do an RFP regarding testing. Second by Mike Heilman. Board members who voted yes were Mike Bitz and Angela Korsmo. Board members who voted no were Greg Allen, Nick Archuleta, Mary Eldredge-Sandbo, Mike Heilman, Rod Jonas, Amy Mann and Marlene Srock. Motion failed.

Janet Welk and Vida Keller met with Chuck Picard from ITD regarding Filenet and Liquid Office manager. The office did an upgrade; another step closer to becoming a paperless office. Janet also met with Della Thorson and Mark Molesworth from ITD regarding Project Oversight/Business Manager Analyst. It was suggested by ITD an oversight manager would not be necessary for small items, tweaking items, etc. The suggestion was to have a business analyst do an audit to oversee office practices, future skills needed in the office, staff training, programmer, etc. This process would enable where to best spend dollars to finish the Nexus project. ITD will bring a proposal to the Board.

On February 16, Janet Welk testified before the Interim Education /Finance Committee regarding OSEL endorsements. Mike Bitz was also in attendance. The intent of NDCC 15.1-13-20 was to accept all out-of-state endorsements. The Board had an opportunity to review various examples of these out-of-state endorsements. Due to conflicting wording, a motion was made by Nick Archuleta to obtain an Attorney General’s Opinion on NDCC 15.1-13-20. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Bill Peterson and Janet Welk will draft a letter for the AG’s office.

BARNES, ERIC
A motion was made by Rod Jonas to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Heilman. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mike Bitz did not vote. Mr. Barnes’ license was before the Board because he was engaged in the profession of teaching while not holding a current license. He is a science teacher with Leeds Public Schools. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

BJERK, TERI
Mike Heilman made a motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Rod Jonas. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mary Eldredge-Sandbo voted no. Mike Bitz did not vote. Ms Bjerk’s license was before the Board because she was engaged in the profession of teaching while not holding a current license. She is employed as a physical education and earth science teacher with Dunseith High School. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

CIMINO, PAUL
A motion was made by Nick Archuleta to issue a five-year other state educator license. Second by Angela Korsmo. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mike Bitz did not vote. Mr. Ciminos’ license application was before the Board because of his background check.

DUTTENHEFER, DAVID
Mr. Duttenhefer contacted the office to renew his driver education endorsement. The driving abstract showed four violations. In order to issue a driver education endorsement, the applicant’s abstract must show no more than three driving violations. Rod Jonas made a motion directing Janet to contact Mr. Duttenhefer to reapply after July 23, 2012. Second by Nick Archuleta. Motion carried. Mike Bitz did not vote. Board members who voted yes were Greg Allen, Nick Archuleta, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. NDCC 15.1.13-09(g)

DEICHERT, MICHELLE
A motion was made by Mike Bitz to dismiss. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Deichert’s license was before the Board due to a possible fine.

FIDELDY, NIKKI
A motion was made by Mike Heilman to dismiss. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Mike Heilman, Rod Jonas and Amy Mann. Board members who voted no were Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Angela Korsmo and Marlene Srock. Ms. Fideldy’s file was before the Board due to a possible fine.

EGEBERG, RACHEL
A motion was made by Angela Korsmo to issue an initial, two-year license. Second by Nick Archuleta. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Egeberg’s license was before the Board due to her background check.

GROVER, JASON
Mike Heilman made a motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Bitz. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mr. Grover is employed as a special education instructor for GST Special Education Unit. His license was before the Board because he was engaged in the profession of teaching while not holding a current license. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

JOHANSEN, JOYCE
Angela Korsmo made the motion to dismiss. Second by Nick Archuleta. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Johansen’s license was before the Board due to a possible fine.

KIETZMAN, KRISTIN
A motion was made by Mike Heilman to proceed with formal disciplinary action and offer an informal settlement agreement of a $50 fine. Second by Mike Bitz. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Kietzman’s license was before the Board because she was engaged in the profession of teaching while not holding a current license. She is employed with Kensal Public Schools as a music teacher. MAY, DONALD
Rod Jonas made a motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Heilman. Motion carried. Mr. May’s license was before the Board because he was engaged in the profession of teaching while not holding a current license. He is employed with Minot Public Schools at Our Redeemers Christian School as a social studies teacher. NDCC15.1-13-25(1)(h) & 15.1-13-17(1)

NEUMANN, SCOTT
Nick Archuleta made a motion to issue a subsequent five-year license; waiving the 4 semester hour requirement. Second by Rod Jonas. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mr. Neumann is employed as an orchestra instructor with Bismarck Public Schools.

PRANTE, DEANNA
A motion was made by Mike Heilman to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Prante’s license was before the Board because she was engaged in the profession of teaching while not holding a current license. She is employed with Enderlin Public Schools in speech pathology/audiology. NDCC 15.1-13-25(1)(h) & 15.1-13.17(1)

SALISBURY, TARA
A motion was made by Nick Archuleta to dismiss. Second by Angela Korsmo. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock.
Ms. Salisbury’s license was before the Board due to a possible fine.

SAYLER, ERIC
Mike Bitz made the motion to dismiss. Second by Angela Korsmo. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mr. Sayler’s license was before the Board due to a possible fine.

SCHMALTZ, CELIA
Mike Heilman made the motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Bitz. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Schmaltz’s license was before the Board because she was engaged in the profession of teaching while not hold a current license. THOMPSON, SUSAN
A motion was made by Rod Jonas to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Bitz. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Thompson’s license was before the Board because she was engaged in the profession of teaching while not holding a current license. She is employed with Surrey Public Schools as a science teacher. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)

WAGNER, KURT
A motion was made by Mike Bitz to dismiss. Second by Angela Korsmo. Motion carried Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Mike Heilman voted no. Mr. Wagner’s license was before the Board because of a possible fine.

WOODBURY, JULIE
Mike Heilman made a motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mary Eldredge-Sandbo, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Ms. Woodbury’s license was before the Board because she was engaged in the profession of teaching while not holding a valid license. She is employed with Parshall Public Schools as an agricultural teacher. NDCC 15.1-13-25(1)(h) & 15.1-13-25

No board reports were given due to time constraints. The meeting was adjourned at 3:45.
