The Education Standards and Practices Board (ESPB) meeting was called to order by board chair, Don Paulsrud. Board members who attended were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann and Marlene Srock. Others who attended the meeting were Diane Weber and Janet Welk from ESPB, Matt Strinden from DPI, LeAnn Nelson from NDEA, Bill Peterson from AG’s Office, Representative Joan Heckaman, John Walstad from Legislative Council, Tracy Klein from the Morton-Sioux Special Education Unit, Terry Tucker from West River Student Services Unit and Terri Finneman from the Bismarck Tribune.

Mary Eldredge-Sandbo did not attend the meeting.

Don Paulsrud welcomed all visitors and asked for introductions to be held.

The special education subcommittee met prior to the board meeting.

Mike Bitz made the motion to approve the January, 2011 minutes. Second by Greg Allen, Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Amy Mann, Don Paulsrud and Marlene Srock.

A motion was then made by Rod Jonas approving the January, 2011 financial report. Second by Nick Archuleta. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Amy Mann, Don Paulsrud and Marlene Srock. The January financial report showed $50, 538.65 in total income, $61,607.10 total expenses, with a minus $11,068.45.

The Board reviewed the recommendations made by Eide BaillyTechnology Consulting. The Board directed Janet to check with ITD in identifying a business analyst and a project manager.

Upon the recommendations from the morning’s Special Education Subcommittee, Rod Jones made the made a motion approving the recommendations suggested, effective immediately to change the appearance of the special education license. On the front page special education will be listed w/the specialty/endorsement shown on the second page. Second by Greg Allen. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Amy Mann, Don Paulsrud and Marlene Srock. The new special education licensure change will give the school districts flexibility in hiring/placement of special education teachers in the special needs areas. The changes will be announced in a press release, inserts in all special education licenses, website and education affiliates. Janet will work with DPI to obtain a new special education code.

John Walstad visited with the Board regarding the administrative rules process, changing rules that are obsolete, etc.

RFP will be developed by the NES/ETS testing companies. In August, 2011, a subcommittee was formed. The committee members are Mike Bitz, Mike Heilman, Nick Archuleta and Janet Welk.

CASES
AKERS, FRANK
Nick Archuleta made the motion to issue a five-year, OSEL license. Second by Mike Bitz. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Aker’s license request was before the Board due to his background check.

BASHFORD, MICHAEL
A motion was made by Mike Bitz to issue an initial, two- year license. Second by Angela Korsmo. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Bashford’s file was before the Board due to his background check.

CISCO, COLE
Greg Allen made the motion to issue a one-year, substitute license. Second by Marlene Srock. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Cisco’s license request was before the Board due to his background check.

DICKERSON, RICHARD
A motion was made by Greg Allen to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Heilman. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Dickerson’s license was before the Board because he was engaged in the profession of teaching while not holding a valid license. He is employed at Dakota Adventist Academy in Bismarck as a physical education instructor. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

DUTTON, CAROL
Rod Jonas made the motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $100 fine. Second by Mike Heilman. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Ms. Dutton’s license was before the Board because she was engaged in the profession of teaching while not holding a valid license. She was working as a substitute teacher for Kidder County Public Schools for school years 2010 and 2011. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

FRESCHETTE, BRIGITTE
Greg Allen made the motion to issue an initial, two-year license. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Ms. Freschette’s license request was before the Board due to her background check.

HOLWEGER, RANDY
Marlene Srock made the motion to issue an initial, two-year license. Second by Amy Mann. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Holweger’s license request was before the Board due to his background check.

JAHNER, CHRISTOPHER
A motion was made by Mike Bitz to issue an initial, two year TITH license. Second by Nick Archuleta. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Jahner’s license request was before the Board due to background check.

MCGILL, JAMES
A motion was made by Mike Bitz to dismiss the case. Second by Angela Korsmo. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. McGill’s license was before the Board due to a possible fine.

MCGILLIS, JESSICA
Greg Allen made the motion to issue an initial, two-year CTE license. Second by Nick Archuleta. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Ms. McGillis’ license request was before the Board due to her background check.

MONTCLAIR, LAWRENCE
Rod Jonas made a motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Mike Heilman. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Montclair’s license was before the Board because he was engaged in the profession of teaching while not holding a valid license. He is employed at Fort Yates Public Schools as an elementary teacher. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

SCHMITZ, KENDI
A motion was made by Angela Korsmo to issue an initial, two-year license. Second by Rod Jonas.
Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jonas, Amy Mann, Don Paulsrud and Marlene Srock. Ms. Schmitz’s license request was before the Board due to her background check.

ST. PIERRE, TERESA
A motion was made by Mike Bitz to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Rod Jonas. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jones, Amy Mann, Don Paulsrud and Marlene Srock. Ms. St. Pierre’s license was before the Board because she was engaged in the profession of teaching while not holding a valid license. She is employed as an elementary teacher with Dunseith Public Schools. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

WILLIAMS, RYAN
Nick Archuleta made a motion to issue an initial, two-year license. Second by Rod Jonas. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jones, Amy Mann, Don Paulsrud and Marlene Srock. Mr. William’s file was before the Board due to his background check.

ZIETZ, KELLAN
A motion was made by Rod Jonas to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Greg Allen. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo, Rod Jones, Amy Mann, Don Paulsrud and Marlene Srock. Mr. Zietz’s license was before the Board because he was engaged in the profession of teaching while not holding a valid license. He is employed as an elementary teacher for Ray Public Schools. NDCC15.1-13-25(1)(h) and 15.1.-13-17 (1)

FREDLOS, JANE
Mike Heilman made the motion to proceed with formal disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Don Paulsrud. Motion carried. Administrative board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo and Don Paulsrud. Ms. Friedlos’ license was before the administrative board she was engaged in the profession of teaching while not holding a valid license. She is employed with Tate Topa Tribal School as an administrator. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

FERGUSON, JOHN
A motion was made by Mike Bitz to proceed with formal disciplinary action and offer an information settlement agreement of a $250 fine. Second by Don Paulsrud. Motion carried. Administrative board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Mike Heilman, Angela Korsmo and Don Paulsrud. Mr. Ferguson’s license was before the administrative board because he was engaged in the profession of teaching while not holding a valid license. Mr. Ferguson is employed as an administrator with White Shield School in Roseglen. NDCC 15.1-13-25(1)(h) and 15.1-13-17(1)

The meeting was adjourned at 3:45 pm.
