Board Retreat - Monday, June 22 thru Wednesday, June 24, 2009

The Education Standards and Practices Board (ESPB) meeting was called to order by vice-chair, Don Paulsrud. Board members who attended were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Rod Jonas, Erin Mowers, Vicki Riegler and Marlene Srock. Others who attended the meeting were Diane Weber and Janet Welk from ESPB and LeAnn Nelson from NDEA. Bill Peterson joined the group via conference call on Tuesday afternoon.
Paul Johnson attended the meeting on Tuesday and Wednesday; Mike Bitz did not attend the meeting on Wednesday.
Outstanding board cases discussion was added to the agenda.
A motion was made by Mike approving the May, 2009 minutes. Second by Rod. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Rod Jonas, Angela Korsmo, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.
A motion was then made by Vicki approving the May, 2009 financial report. Second by Greg. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Rod Jonas, Angela Korsmo, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. The May financial statement showed $65,133.87 in total income received; $63,598.47 in total expenses incurred with a net income of $1,535.40.
Mike made the motion approving the licensure report. Second by Erin. Motion carried. Board members who were in favor were Greg Allen, Nick Archuleta, Mike Bitz, Rod Jonas, Angela Korsmo, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. The May, 2009 licensure report showed 369 total licenses issued.
Discussion was held on the critical shortages and geographic hardship shortages. Mike made the motion to keep the critical shortages as all content areas except elementary education and physical education for the 2009-2010 school year. Second by Angela. Motion carried. Board members who agreed were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. A motion was then made by Nick for Janet to research and bring to the June 2010 meeting, what other states are declaring as geographic hardship shortages, for example on reservations. Second by Greg. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.
The Board discussed 2009-2010 meeting dates. The dates are as follows: June 20, August 13, September 10, October 8, November 12, December 10, January 14, February 11, March 11, April 8, May 13 and retreat dates June 20 thru 22nd. Janet reminded the Board, ESPB will be hosting the Joint Boards Meeting which will be in Bismarck on Tuesday, September 22. Since the board membership/makeup did not change, all members serving on various board committees did not change as well.
In order to assist in obtaining grant dollars for “the American Recovery and Reinvestment Act of 2009: Saving/Creating Jobs and Reforming Education”, ESPB has offered $5,000 to provide for a grant writer. At this time, no other agency has offered to match any dollars.
P-20 agency group is developing a white paper to try and bring information together on what has been accomplished, the new authority of the Joint Boards in relation to the Race to the Top dollars and the Governor’s Commission.
Greg made the motion approving signing the office lease for 2 years at $9 square ft/$960 a month. Second by Angela. Motion carried. Board members who vote yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Discussion was done about a possible office move. It would be nice to have additional space since there will be a new teacher support system project coordinator. The concern is that the grant may not be available after two years and the office would be committed to the additional cost for the extra space.
A review of the 2nd Administrative Rules draft was done.
An overview was done by the licensure subcommittee meeting. Don made the motion to accept the licensure subcommittee’s recommendation of expanding the multicultural education/Native American studies/diverse learners to rename and align with standards rewrite for a human relations course and remove the 2 semester hours requirement. Second by Erin. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. The licensure subcommittee will also study the National Council on Teacher Quality reports.
Marlene reported for the professional development committee. The top six applicants were named for the project coordinator position. The applicants will be interviewed on Wednesday, July 8th. The interview team will consist of Janet, Paul, Rod, LeAnn Nelson and Doug Johnson. It is hoped the new person would be able to start August 3rd.
ADMINISTRATIVE CASES
BLUESTONE, MARC
Paul made the motion to dismiss the case. Second by Don. Motion carried. Administrative members who voted yes were Greg Allen, Mike Bitz, Angela Korsmo, Paul Johnson, Erin Mowers and Don Paulsrud. Mr. Bluestone’s license was before the Board because yes was checked on question #3, section two of the renewal form. He is employed at New Town Public School as an administrator.
GOURNEAU, DAVID
A motion was made by Mike to dismiss the case. Second by Angela. Motion carried. Administrative members who voted yes were Greg Allen, Mike Bitz, Angela Korsmo, Paul Johnson, Erin Mowers and Don Paulsrud. Ms. Gourneau’s license was before the administrative board due to a request for inquiry that was filed. Mr. Gourneau is employed with Turtle Mountain Community Schools as an administrator.
NAASZ, CLYDE
Paul made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine. Second by Don. Motion carried. Administrative board members who were in agreement were Greg Allen, Mike Bitz, Angela Korsmo, Paul Johnson, Erin Mowers and Don Paulsrud. Mr. Naasz was engaged in the profession of teaching while not holding a valid license. He was employed at Fort Yates Public Schools as an administrator. NDCC 15-1-13-17(1) & 15-1-13-25(1)(h)
SVIHL, GREG
A motion was made by Don to offer a settlement agreement because Mr. Svihl did violate his original agreement. Second by Mike. Motion carried. Administrative members who voted yes were Greg Allen, Mike Bitz, Angela Korsmo, Paul Johnson and Don Paulsrud. Don then made a motion to take further disciplinary action:
1) to place Mr. Svihl’s license on probation for one year from the date of execution of the agreement
2) as a condition of probation, Mr. Svihl participates in the aftercare program and follow the recommendations of treatment. The treatment center will provide quarterly report
3) as a condition of probation, Mr. Svihl will comply with all laws/rules governing the profession
Second by Mike. Motion carried. Administrative members who voted yes were Greg Allen,
Mike Bitz, Angela Korsmo, Paul Johnson and Don Paulsrud. Mr. Svihl is employed at Eight Mile
Public School district as an administrator. NDCC 15.1-13-25(1)(a)(b)(c)(d)(e)(j) and ND Adm. Code 67.1-03-01-03(5)(6)
TITUS, GARRETT
The office is to send fingerprint materials to Mr. Titus. Mr. Titus’ license was revoked in October, 2004 for theft of property.
WOLSKY, JASON
Angela made the motion to file a request for inquiry. Second by Paul. Motion carried. Administrative members who voted yes were Greg Allen, Mike Bitz, Angela Korsmo, Paul Johnson, Erin Mowers and Don Paulsrud. Mr. Wolsky’s license was before the administrative board due to a criminal judgment of forgery.
YELLOW FAT, TERRENCE
Mr. Yellow Fat will need to provide a letter of explanation regarding his employment start date.
He is employed at Standing Rock Community School. His license request is before the Board due to a possible fine and revocation of his license.

GERNTHOLZ, MARIAN
Nick made the motion to contact Valley City Vocational Center and find out the number of days Ms. Gerntholz was substitute teaching for 2007 and 2008 school year. Second by Don. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jones, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Ms. Gerntholz’s license is before the Board due to a possible fine.
HANSON, RYAN
At 2.35 pm the Board went into executive session and reconvened at 2:45 pm. A motion was made
by Rod to proceed with disciplinary action because Mr. Hanson failed to meet the conditions of probation set forth in paragraphs 3 and 4 of the Order. Second by Don. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Rod then made the motion to revoke Mr. Hanson’s license. Second by Erin. Motion carried. Board members who voted yes were Mike Bitz, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Board members who voted no were Greg Allen, Nick Archuleta and Angela Korsmo. Mr. Hanson’s license was before the Board due to noncompliance of an improvement plan. He was an elementary teacher at Minnewaukan Public Schools. ND Adm Code 67.1-02-02-06(1)(4) and NDCC 15.1-13-25(1)(d)(e) and ND Adm. Code 67.1-02-02-06(1)(4)

Nick made the motion to dismiss the case. Second by Vicki. Motion carried. Ms. Nowatski’s license was before the Board due to a possible fine.
PRUITT, GREG
A motion was made by Vicki to issue a two-year, initial license. Second by Mike. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Mr. Pruitt’s license was before the Board due to his background check.
QUALLEY, BRIAN
Rod made the motion to issue an initial, two-year license. Second by Angela. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas and Marlene Srock. Erin Mowers, Don Paulsrud and Vicki Riegler voted no. Mr. Qualley’s license request was before the Board due to his background check.
SWANSON, LAURA
A motion was made by Nick to extend time to 1 year to complete two credits needed for her five-year renewal. Second by Don. Motion carried. Board members who were in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. The extension was allowed by the Board due to her young son who has a serious illness. She is employed with Little Flower Elementary School in Rugby. NDCC 67.1-02-02-05
THOMAS, CHRISTINE
A motion was made by Greg to issue an initial, two-year license. Second by Mike. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Ms. Thomas’ application for a license was before the Board due to her background check.
URLAUB, JEFFREY
No action was taken by the Board. Mr. Urlaub’s license was before the Board due to his driver’s education endorsement. He is currently employed at Cavalier Public School as social studies, physical education and driver’s education instructor.
WERNER, CHARLES
Mike made the motion to issue a two-year, initial license. Second by Rod. Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Mr. Werner’s license request was before the Board due to his background check.
ZELLER, ANNETTE
Mike made the motion to offer a settlement agreement of a $50 fine. Second by Vicki. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Mike Bitz, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Ms. Zeller was engaged in the profession of teaching while not holding a current license. She is employed with Flasher Public Schools as a substitute teacher. NDCC 67.1-01-01-03
Janet reviewed the 2009-2010 budget with Don and Paul. Don and Paul submitted their budget recommendations to the Board. A motion was made by Greg approving the 5% budget sample. Second by Angela. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.
The Board also discussed topic ideas for 2009-2010 meetings. Much discussion was also held regarding agenda items for the Joint Boards Meeting on September 22.
The retreat adjourned on Wednesday, June 24 at 11:45 am.
