The Education Standards and Practices Board (ESPB) meeting was called to order by board chair, Paul Johnson.   Board members who attended were Greg Allen, Nick Archulta, Angela Korsmo, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. Others who attended the meeting were Diane Weber and Janet Welk from ESPB, Bill Peterson from the Attorney General’s Office, Fern Porkorny from the North Dakota Education Association.

Mike Bitz did not attend the meeting.  Rod Jonas arrived after the approval of the minutes.

A motion was made by Don approving the December, 2008 minutes.  Second by Greg.  Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 

A motion was then made by Angela approving the December, 2008 financial report.  Second by Nick.  Motion carried.   Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  The December financial statement showed $27,779.86 in total income received; $49,113.64 in total expenses incurred with a net income of a minus $21,333.78.  The December financial report showed $30,000 transfer of funds from the Capitol Credit Union money market account into checking.  An additional $700.89 was transferred from the technology account into checking; closing the technology account.  A Starion CD was closed with money placed into a new/another CD at Cornerstone Bank.

Don made the motion approving the licensure report.  Second by Marlene.  Motion carried.  Board members who were in favor were Greg Allen, Nick Archuleta, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. The December, 2008 licensure report showed 411 total licenses issued.

Paul and Don summarized Janet’s evaluation results.  The director’s evaluation was completed, signed and filed.

The Education Commission report has been finalized.  The report may be viewed on the Commission’s website.

Rod summarized the Program Approval Advisory Committee (PAAC) recommendations for Valley City State University Program Approval standards.  Greg made the motion to accept PAAC’s recommendation as met for Advanced Professional Education program.  Second by Paul.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.   Don then made the motion to accept the team’s recommendation for the Art (Visual Arts) program as met.  Second by Angela.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Nick made the motion to accept PAAC’s recommendation as met for Business Education.
Second by Don.  Motion carried.  Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Vicky then made the motion to accept the team’s recommendation as met for Career/Technical Education program.  Second by Greg.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Don again made the motion to approve the Early Childhood Education minor as met w/weakness.  Second by Nick.  Motion carried. Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.    Angela made the motion to approve Elementary Education as met.  Second by Don.  Motion carried.  Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Nick then made the motion to accept PAAC’s recommendation as met for English Language Learner Endorsement.  Second by Angela.  Motion carried.  Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Don then made the motion to accept English Education program as met; second by Erin.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.   Greg made the motion to accept the Health Education standard as met; second by Vicki.  Motion carried.  Board members who voted in agreement were Greg Allen; Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Nick made the motion to accept History Education, Library Science Education and Mathematics Education as met.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.   Don then made the motion to accept PAAC’s recommendation for Middle School Pedagogy endorsement, Instructional Music Education, Composite Music Education, Vocal Music Education, Physical Education, Biology Education, Chemistry Education and Composite Social Science Education as met.  Second by Angela.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela

Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.    Angela made the motion to accept PAAC’s recommendation for Spanish Education and Technology Education as met.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Greg made the motion to accept the Multicultural Education /Native American Studies standard as met.  Second by Don.  Motion carried.  Board members who were in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 

Don then made the motion accepting PAAC’s recommendation of provisional approval w/a focus visit in spring, 2011 for Mayville State University Early Childhood Education major.   Second  by Vicki.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 

Again, Don made the motion to approve PAAC’s recommendation for provisional approval w/a full visit in spring, 2011 for School Counseling Master’s Program with the University of Mary.  Second by Marlene.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Rod Jonas did not vote. 

Laura Matzke provided a presentation on para professional requirements.

CASES
BAUER, ALLAN
Rod made the motion to add the driver education endorsement to Mr. Bauer’s license.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 
Mr. Bauer’s endorsement request was before the Board because of a record on his driving abstract.  Mr. Bauer is employed at Munich Public Schools.

BALZER, DIANE
A motion was made by Angela to issue a reentry, two-year license.  Second by Nick.  Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Ms. Balzer’s renewal request was brought to the Board because of her background check. 

BAUMGARTNER, DOROTHY
Don made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine.  Second by Angela.  Motion carried.  Board members who were in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Ms. Baumgartner was engaged in the profession of teaching while not holding a valid license.  She was employed at Ojibwa Indian School at Belcourt as a substitute teacher.   NDCC 15-1-13-17(1) & 15-1-13-25(1)(h)

CLARK, MARK
A motion was made by Nick to revoke Mr. Clark’s driver education endorsement from his teaching license.  Second by Erin.  Motion carried.  Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  He is employed at Selfridge Public Schools.  Adm. Rule 67-1-02-03-06(q)

FERRIE, RUSSELL
A motion was made by Don to add the driver education endorsement to Mr. Ferrie’s license.  Second by Greg.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Vicki Riegler did not vote.  He is employed at St. Mary’s High School in Bismarck.

GILBERT, EVERETT
Don made the motion to revoke Mr. Gilbert’s teaching license.  Second by Vicki.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Mr. Gilbert was convicted of a sexual offense against a child.  He currently was not teaching; but was employed at New Public School.

HANSON, RYAN
Much discussion was done by the Board.  Don then made the motion for our legal council to notify Mr. Hanson that he is not complying with the settlement agreement.  Second by Greg.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 

JOHNSON, MELISSA
A motion was made by Angela to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine.  Second by Erin.  Motion carried.   Board members who voted in agreement were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Ms. Johnson was engaged in the profession of teaching while not holding a valid license.  She is employed at North Valley Area Career/Tech Center at Grafton.  NDCC 15-1-13-17(1) & 15-1-13-25(1)(h)

KING, DARIN
Nick made the motion to dismiss the case.  Second by Rod.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Mr. King’s license was brought to the Board due to a possible fine.  He is employed as the technology director with Grand Forks Public School system.

MARSHALL, JOEL
A motion was made by Don to add the driver education endorsement to Mr. Marshall’s license.  Second by Erin.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Mr. Marshall is employed at Hazen Middle School.

OLHEISER, RENA
A motion was made by Angela to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine.  Second by Greg.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Ms. Olheiser was engaged in the profession of teaching while not holding a valid license.  She is employed at Beach Public Schools.  NDCC 15-1-13-17(1) & 15-1-13-25(1)(h)

TURNER, KEVIN
Rod made the motion to proceed with formal disciplinary action and offer a settlement agreement of a $250 fine.  Second by Don.  Motion carried.   Board members who voted yes were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.  Mr. Turner was engaged in the profession of teaching while not holding a valid license.  He is employed with the Parshall Public School system.  NDCC 15-1-13-17(1) & 15-1-13-25(1)(h)

VAN KLOOTWYK, STEPHANIE
A motion was made by Nick to contact Standing Rock Community Elementary School for the name of the licensed teacher who was in the classroom when Ms. Van Klootwyk’s license expired.  Second by Greg.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock. 

Don then made the motion to adjourn the meeting.  The meeting adjourned at 2:05.  Second by Vicki.  Board members who voted in favor were Greg Allen, Nick Archuleta, Angela Korsmo, Paul Johnson, Rod Jonas, Erin Mowers, Don Paulsrud, Vicki Riegler and Marlene Srock.
