The Education Standards and Practices Board (ESPB) meeting was called to order by Pam Cronin, Board chair.  Board members present were Nick Archuleta, Greg Allen, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Staff personnel who attended were Diane Weber and Janet Welk. Visitors were Fay Kopp from Teachers Fund for Retirement and Bill Peterson from the Attorney General’s Office.

Board member, Marlene Shrock did not attend the meeting.

A motion was made by Dan to add national board discussion to the agenda. Second by Don.  Motion carried.   Board members who voted yes were Nick Archuleta, Greg Allen, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.

Greg made the motion approving the 2008 March minutes.  Second by Kathy.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.

A motion was then made by Don to approve the 2008 March financial statement.  Second by Neil. Motion carried.   Board members who were in agreement were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  The financial statement showed $33, 804.08 in total income received; $40,034.22 in total expenses with a net income of a minus $6,230.14.  Janet reported to the Board that several CD’s were up for renewal.  She has reinvested the dollars with brokered CD’s; Edward Jones and US Bancorp.  The transfer/new accounts will be reflected in the April financial statement.

The Board reviewed the licensure report.  The 2008 March licensure report showed 217 total licenses issued.  Don made a motion to approve the licensure report.  Second by Nick.  Motion carried.   Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.

In April, program approval reviews will be held at Mayville State University and University of North Dakota.  Janet informed the Board that University of Mary has submitted their business education program for approval and United Tribes Technical College has submitted intent to seek approval for early childhood education with an endorsement in early childhood special education.

North Dakota’s ETS test validation studies will be held on April 28 and May 1 for agriculture education and early childhood special education.  At this time, the office was not able to secure complete panels for the other content test studies.  The rescheduled dates for the remaining content test studies are the first week in December.

Neil summarized the professional development subcommittee’s recommendations.  Dan made the motion to approve the recommendations of the subcommittee.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  The subcommittee’s recommendations were 1) raise the 4 semester hours for the 5 year renewal to 5 semester hours on July 1, 2010 and 6 semester hours on July 1, 2012 and 2) develop standards for the professional development credit. The Board also discussed future plans for development of a portfolio for the re-education requirement to help align the needs of the school district with the needs of the individual teacher for improved learning for the students. 

Kathy provided the licensure subcommittee’s findings regarding teaching out-of-field.  Much discussion was done by the Board.  Dan made the motion to send a certified/return receipt letter to the teacher and administrator of the school that ESPB is aware of the out-of-field situation, if this happens again next year, the teacher and administrator will be disciplined.  Second by Don.   Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist and Dan Vainonen.  Janet will e-mail the draft to the Board prior to the mailing.   NDCC 15.1-18-10(c) & 25

Fay Kopp gave a presentation on TFFR facts.

It was asked of Bill to complete the national board stipends opinion.

CASES
Anderson, Rachel
Much discussion was done by the Board.  Paul made a motion to proceed with disciplinary action.  Second by Dan.  Motion carried.  Board members who voted yes were Greg Allen, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen. Nick Archuleta voted no.  Paul then made the motion to offer a settlement agreement to suspend her license for one year OR until proper release of her teaching contract is made.  Second by Neil.  Motion carried.  Board members who voted in favor were Greg Allen, Nick Archuleta, Pam Cronin,
Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen. Ms. Anderson was employed with Upper Valley Special Education Unit in Grafton.  Her license was brought to the Board due to a request of inquiry filed for breach of contract.  NDCC 15-1-13-25(1)(g)(j)    

Detweiler, Stan
Neil made the motion to proceed with disciplinary action and offer a settlement agreement of $250 fine.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Mr. Detweiler has been employed at Dakota Adventist Academy for the 2007-08 school year as a physical education instructor.  NDCC 15-1-13-25(1)(h) & 15.1.13-17(1)

Hagen, Melanie
A motion was made by Don to proceed with disciplinary action and offer a settlement agreement of a $250 fine.  Second by Greg.  Motion carried.  Board members who were in agreement were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Ms. Hagen is employed at Westhope Public School as an elementary teacher.  NDCC 15-1-13-25(1)(h) & 15.1.13-17(1)

Meinert, Jeremy
Paul made the motion to issue an initial, two-year license.  Second by Angela.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Mr. Meinert’s license was brought before the Board due to question #3, section two of the application form. 

Nenow, Maria
A motion was made by Neil to proceed with disciplinary action and offer a settlement agreement of a $150 fine.  Second by Don.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Ms. Nenow is employed at Dakota Prairie High School in Petersburg as an English teacher.  NDCC 15-1-13-25(1)(h) & 15.1.13-17(1)

Pogatshnik, Vicki
A motion was made by Don to proceed with disciplinary action and offer a settlement agreement of a $250 fine.  Second  by Dan.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Ms. Pogatshnik has been employed as a sub at Casselton Public Schools. NDCC 15-1-13-25(1)(h) & 15.1.13-17(1)

Schumacher, Michelle
Much discussion was done by the Board.  Paul made the motion to proceed with disciplinary action.  Second by Dan.  Motion carried.  Board members who voted yes wereGreg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  A motion was than again made by Paul to issue a letter of reprimand stating the seriousness of breaking a contract in North Dakota means the suspension of one’s license.  Second by Nick.  Board members who were in agreement were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angelo Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen. The Board directed Janet to notify the Linton School Board regarding the seriousness of a breach of contract.  Ms. Schumacher license had been suspended in South Dakota.  She is employed by the Linton Public Schools as a music teacher.  NDCC 15-1-13-25(1)(g)(j) &  ND Adm Code 67.1-03-01-03(10)  

Stratton, Kristen
Don made the motion to proceed with disciplinary action and offer a settlement agreement of a $250 fine.  Second by Neil.  Motion carried.   Board members who were in favor were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen.  Ms. Stratton is employed with Sawyer Public School as an English teacher.  NDCC 15-1-13-25(1)(h) & 15.1.13-17(1)

Sudduth, Kelly
Don made the motion to table; seeking further information regarding employment as a sub for the West Fargo School District.  Second by Neil.  Motion carried.  Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Kathy Kiedrowski, Angela Korsmo, Paul Johnson, Neil Nordquist, Don Paulsrud and Dan Vainonen. 

ADMINISTRATIVE CASE
Svihl, Greg
A motion was made by Greg to obtain a copy of Mr. Svihl’s letter of resignation and copies of his old application forms.  Second by Paul.  Administrative board members who voted yes were Greg Allen, Pam Cronin, Angela Korsmo, Paul Johnson and Dan Vainonen.  Mr. Svihl’s license was brought before the administrative board due to his court records.  He is employed as the principal at Eight Mile Public School in Trenton. 

The next board meeting is May 8.
