The Education Standards and Practices Board (ESPB) meeting was called to order by Pam Cronin, Board chair. Board members present were Greg Allen, Nick Archuleta, Angela Korsmo, Don Paulsrud, Marlene Srock and Dan Vainonen. Staff personnel who attended the meeting were Diane Weber and Janet Welk. Visitors were Dakota Draper from the North Dakota Education Association, Doug Johnson from the North Dakota Lead Center, Vickie Kelly, Gary Fitzgerald and Don Warren from the Oakes Public School District and Bill Peterson from the Attorney General’s Office.
Board members, Kathy Kiedrowski and Neil Nordquist did not attend the meeting.
The Professional Development Subcommittee met prior to the meeting. The Board also had an opportunity to visit with Ray Simon, Deputy Secretary of Education.
Don made the motion to add the June retreat as an agenda item. Second by Dan. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen.
Don then made a motion to approve the February, 2008 minutes. Second by Greg. Motion carried. Board members who were in agreement were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen.
A motion was made by Dan approving the February, 2008 financial report. Second by Don. Motion carried. Board members who voted in favor were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. The February financial statement revealed $42,119.44 in total income received, $44,593.53 in total expenses, with a net income of minus $2,474.09. Two new CD’s were opened; one at Dakota Community Bank and another at Starion Bank. Also in the month of February, a transfer of $20,000 from the money market account was made into the checking account.
Greg made a motion to approve the February, 2008 licensure report. Second by Angela. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. The February licensure report showed 240 total licenses issued.
Janet briefed the Board on the 2007 Administrative Rules. Major changes were 1) fingerprinting checks extending the time received from 6 months to 18 months, 2) student teachers being eligible for a 40-day provisional license 3) testing for non-core academic areas, 4) authority to issue driver’s education and special education endorsements, 5) alternative access license and successful completion of all testing requirements and 6) new language for national board. July 1, 2008 is the tentative effective date for the 2007 administrative rules. Don made a motion approving the final draft. Second by Paul. Motion carried. Board members who agreed were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. It was suggested to place a summary on the website citing the rules changes and effective date.
The Board reviewed the comments made by Mahlum/Goodhard, PC management letter related to the June 30, 2007 year end audit. Paul made the motion approving the 2007 audit report. Second by Nick. Motion carried. Board members who agreed were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Copies of the audit report will be forwarded to the State Auditor’s Office.
Information was provided to the Board regarding test validation progress. The Board also agreed to accept the professional groups of audio logy and speech-language pathology cut scores of 600. Nick made the motion to accept. Second by Don. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. There are 41 audiologists in the state; only 12 audiologists working in schools.
CASES
Blair, John
A motion was made by Nick to accept Mr. Blair’s current recommendations in lieu of the required contracted administrators and issue a two-year, out-of-state reciprocal license. Second by Dan. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Mr. Blair made the request because his last contracted employed school has been disbanded.
Engle, Mary
Paul made the motion to proceed with disciplinary action and offer an informal settlement agreement of a $100 fine. Second by Don. Motion carried. Board members who were in favor were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Ms. Engle’s license was brought before the Board because she was engaged in the profession of teaching without a teaching license. She is employed Barnes County North-Wimbledon/Courtney Public Schools as a business education teacher. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)
Finders, Andrea
Don made the motion to proceed with disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Greg. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Ms. Finder’s license was brought before the Board because she was engaged in the profession of teaching without a teaching license. She is employed at Rickard Elementary School in Williston as an elementary teacher. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)
Kelly, Vickie
A request for inquiry had been filed. Much discussion was done by the Board. Don made the motion to dismiss the request for inquiry. Second by Marlene. Motion carried. Board members who were in agreement were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. A request for inquiry had been filed due to a possible code of ethics issue. She is employed at Oakes Elementary School as an elementary teacher.
Krebs, Patricia
Dan made a motion to proceed with disciplinary action and offer an informal settlement agreement of a $250 fine. Second by Don. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Ms. Kreb’s license was brought before the Board because she was engaged in the profession of teaching without a valid teaching license. Jorstad, Lori
A motion was made by Paul to proceed with disciplinary action and offer a settlement agreement of a $250 fine. Second by Angela. Motion carried. Ms. Jorstad’s license was brought before the Board because she was engaged in the profession of teaching without a teaching license. A motion was made by Nick to obtain more information; was Ms. Mann in the classroom while her license had expired? Second by Angela. Motion carried. Board members who voted yes were if Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Ms. Mann’s license was brought before the Board due to a possible fine.
Moore, Jennifer
Paul made the motion to proceed with disciplinary action and offer a settlement agreement of a $50 fine. Second by Nick. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Ms. Moore’s license was brought to the Board because she had been engaged in the profession of teaching without a license. She is employed at Mandan High School as a special education teacher. Ms. Vandal’s license was brought before the Board because she was engaged in the profession of teaching without a valid license. Walsh, Nathan:
Don made a motion to precede with formal disciplinary action an offer a settlement agreement of a $250 fine. Second by Dan. Motion carried. Board members who voted yes were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Mr. Walsh’s license was brought before the Board because he was engaged in the profession of teaching without a valid license. He is employed as a math teacher at Central Valley, Public School, Buxton. NDCC 15.1-13-25(1)(h) & 15.1-13-17(1)
Patterson, Richard
Nick made the motion to issue a two-year, initial license. Second by Don. Motion carried. Board members who agreed were Greg Allen, Nick Archuleta, Pam Cronin, Angela Korsmo, Paul Johnson, Don Paulsrud, Marlene Srock and Dan Vainonen. Mr. Patterson’s license application was brought before the Board due to his background check.
Administrative
Fitzgerald, Gary
Pam made the motion to dismiss the request for inquiry. Second by Angela. Motion carried. The administrative board who voted in favor was Paul Johnson, Pam Cronin, Angela Korsmo, Greg Allen and Dan Vainonen. Mr. Fitzgerald’s license was brought before the administrative board for a possible code of ethics issue. He is the elementary administrator at Oakes Public Schools.
Gourneau, Gerald
A motion was made by Pam to proceed with disciplinary action and offer a settlement agreement. Second by Greg. Motion carried. The administrative board who voted yes was Paul Johnson, Pam Cronin, Angela Korsmo, Greg Allen and Dan Vainonen. Pam then made a motion that Mr. Gourneau shall:
1) every 6 months, do background check
2) take an anger management course, which is approved by ESPB’s executive director and board chair
3) quarterly, complete an alcohol evaluation and follow treatment recommendations
4) provide documentation of successful completion of the Nebraska probation.
Second by Greg. Motion carried. Administrative board members who voted yes were Paul Johnson, Pam Cronin, Angela Korsmo, Greg Allen and Dan Vainonen. Mr. Gourneau’s license was brought to the administrative board because of criminal charges in Nebraska. NDCC 15.1-13-24&25& 29
Warren, Don
A motion was then made by Paul to dismiss the request for inquiry that had been filed. Second by Angela. Motion carried. The administrative board who voted in favor were Paul Johnson, Pam Cronin, Angela Korsmo, Greg Allen and Dan Vainonen. Mr. Warren’s license was brought before the administrative board due to a possible code of ethics issue. Mr. Warren is employed with Oakes Public Schools as a secondary elementary principal.
The retreat will be held June 24 thru 26 at Minot State University.
Meeting was adjourned at 2:00 pm.
