 2013 Legislature

The 2013 Legislature has passed HB1358 and SB2013.  HB1358 provides significant increases to direct oil and gas tax distributions to cities, counties, townships and school districts in oil and gas producing counties. HB1358 appropriates $240 million to the oil and gas impact grants fund that is the source for grants to political subdivisions for projects needed as a direct result of impacts of oil and gas development.
 
Of the $293.3 million available for grants, the legislation earmarked the following:
Airports, in coordination with                                        $60 Million
the ND Aeronautics Commission.            
Higher Education                                                            $4 Million
Dust Control Pilot Program                                             $3 Million
County Sherriff Departments                                          $7 Million
Emergency Medical Services                                          $7 Million
Fire Protection Districts                                                $3.5 Million
Hub City Grants, limits grant to:                                     $14 Million
Williston-$2m, Dickinson-$7m, Minot-$5m
 
The legislative changes are resulting in program changes that are still being evaluated. With resulting increased direct distributions provided to political subdivisions, the grants program is expected to focus increasingly on unfunded, unmet needs, especially projects targeting safety issues.

City Infrastructure Grant Round - Application Deadline Extended To Midnight, May 8, 2013
The Energy Infrastructure and Impact Office has exteneded the deadline for applications for the city infrastructure grant round.  The original application deadline was April 30, 2013, with the new deadline being midnight on May 8, 2013.  Mailed applications must be postmarked by May 8th.  Applications can be e-mailed to energyimpact@nd.gov or faxed to (701)328-3650 until 11:59 p.m., May 8, 2013.

The deadline has been extended to accommodate final Legislative decisions of the policies and the amount of money appropriated for the oil and gas impact grants.  Please see the press release announcing the extension using this link.

City Infrastructure Grant Round, First Round in Advance of the 2013-2015 Biennium
The Board of University and School Lands (Land Board) has approved the Energy Infrastructure and Impact Office, to open a grant round for cities experiencing infrastructure needs as a result of oil and gas development. Applications will be accepted until midnight May 8, 2013 from qualifying cities. Please see the grant round announcement for more details using this link.
 
  
Criteria and Recommendations
The Energy Impact advisory committee has developed criteria and recommendations for the allocation of the grant funds. The current grant rating system includes the following rating categories:
  • Objective
  • Project Readiness
  • Result of Energy Activity
  • Relates to health, welfare, and safety
  • Budget

Each entity should apply for the funds on a project basis. The funds are not intended to be dispersed without a project application.

Advisory Committee
The Legislature authorized the Land Board to appoint an advisory committee to assist in making its grant award determinations.

The committee established to make recommendations regarding policies, procedures and distributions of 65% of the Oil and Gas Impact Fund available to the smaller cities, counties, townships and other eligible political subdivisions, is made up of nine members:
