North Dakota Division of Juvenile Services PREA Data

The Division of Juvenile Services maintains a policy that states in part:

When receiving an allegation that a juvenile was sexually abused while confined at another facility, the head of the facility will notify the appropriate office of the agency when the sexual abuse is alleged to have occurred. The head of the facility will also notify the appropriate investigative agency. ( North Dakota Youth Correctional Center Policy 3C-4)

Persons who wish to make a report regarding sexual abuse or sexual harassment which is alleged to have occurred while a youth was placed at the North Dakota Youth Correctional Center should contact:

PREA requires “incidents” to be recorded in one of three categories: 1) Substantiated; 2) Unsubstantiated; or 3) Unfounded. Below is a compilation of the reported incidents at the North Dakota Youth Correctional Center (NDYCC) that meet PREA definitions since 2005, which is when the data began to be collected in this format.

*These incidents were substantiated, meaning that they were found to have occurred. All of these incidents occurred between resident youth, and none involved staff. Examples include a boy slapping a girl on the rump as she went ahead of him on the stairs at the school, a boy and a girl attempting to sneak a kiss, 2 boys rough housing during showers after recreation, and a girl brushing against another girl's chest while doing work projects in the cottage.

PREA asks the following types of conduct be reported: youth -on -youth non-consensual sexual acts, youth-on-youth abusive sexual contact, staff sexual misconduct and staff sexual harassment. All of the North Dakota incidents were categorized as youth-on-youth abusive sexual contact. PREA also requires the nature of the incident be reported. All but one of the incidents was described as unwanted touching for sexual gratification. One incident was described as voluntary sexual contact between youth (an incident of kissing).
