Background Checks for Child Care Providers

For Public Information - Nov. 10, 2018 - The North Dakota Department of Human Services has received approval for a wavier on the provisional employee requirement through Sept. 30, 2019. The time-limited waiver will allow new employees hired by licensed child care providers to begin employment under direct supervision before their fingerprint-based background checks are complete.

If providers have new employees who have submitted a background check application to the department’s Criminal Background Check Unit, but have not yet received a preliminary results memo, they can begin work under direct supervision. For any employees hired on or after Dec. 6, 2018, they can begin working under direct supervision upon submitting their background check application.

Who needs a background check?

  • All individuals providing licensed child care, including self-declared providers
  • All adult household members of family providers and group providers (only if operating out of your home)
  • All individuals working for a child care provider
  • All volunteers who may have unsupervised access to children

What do I need to complete a background check?

Where can I get fingerprinted?

  • Any human service center located in 8 regions throughout the state. See the table below for the center that covers your county.
    • You must call the human service center to schedule an appointment.
    • You must bring all three completed SFN forms with you.
    • You must bring a valid photo ID (drivers license, state ID, military ID, passport, tribal ID).
    • There is no charge.
  • Any law enforcement office or third party that is authorized to.
    • You should contact them to get times and days they do fingerprinting.
    • You must bring all three completed SFN forms with you.

    • You or your prospective employer (provider) are responsible to pay any fees associated with being fingerprinted.

    • North Dakota criminal record (non-public)
    • Child Abuse/Neglect Index (non-public)
    • FBI criminal record (non-public)
    • National Sex Offender Registry (non-public)
    • North Dakota Sex Offender Registry (public)
    • North Dakota Offenders Against Children Registry (public)
    • Tribal Court & Child Welfare (as needed)
  • If you lived outside of North Dakota at any time during the past 5 years, your background check will also include:
    • State Child Abuse/Neglect Registry in every state you lived in during the last 5 years.
    • State Sex Offender Registry in every state you lived in during the last 5 years.
    • State criminal record in every state you lived in during the last 5 years.

What can I do to help my background check be completed quicker?

  • Make sure all three forms are completed in full.
    • No boxes should be blank.
    • Make sure address history is a FULL 5 years (Example: if you complete, sign and date your forms on September 15, 2018 – your address history must go back through at least September 1, 2013)
    • Re-submit corrected forms as soon as possible.
  • Submit authorization forms for other states as quickly as possible.
    • Make sure the form is complete, signed and dated, and signature is witnessed or notarized, if required.
    • Make sure photo ID, self-addressed stamped envelope and additional fingerprints are attached to the completed forms before mailing them to the department.
