Americans with Disabilities Act (ADA)
As the lead state agency in North Dakota for Title II (Public Services) and Title III (Public Accommodations and Commercial Facilities) of the ADA, training and technical assistance is provided to both public and private agencies to assist them in complying with the various provisions of the act.
The DCS also receives and responds to numerous questions on requirements of the Disability Act Accessibility Guidelines.
N.D.C.C. Chapter 54-21.3-04.1 establishes the Americans with Disabilities Act Accessibility Guidelines (ADAAG) as the specific accessibility standards applicable to new construction, alterations, and new additions to buildings and facilities throughout North Dakota that are subject to the Americans with Disabilities Act (ADA). Under this law, state agencies and governing bodies of political subdivisions are to "require from any person preparing plans and specifications for a building or facility subject to the Americans with Disabilities Act of 1990, a statement that the plans and specifications are, in the professional judgment of that person, in conformance with the Americans with Disabilities Act Accessibility Guidelines for Buildings and Facilities." A copy of the ADAAG Conformance Statement (24kb pdf) is available. The completed form is to be retained by the permitting jurisdiction or state agency, and a copy is to be filed with the North Dakota Division of Community Services.
